K JCK officially asks the ombudsman to bring the Law for the Reward to the Constitutional Court

According to the CGRCH, the Law on Salaries in the Public Sector is contrary to the Constitution, Law No. 06/L-054 for the Courts, Council of Europe recommendations on the independence of the judiciary, the opinion of the Consultative Council of European Judges and the Constitutional Court Act of KO 2/03/19.

Kosovo Judicial Council “ (KGJK), with the 15th of February 2023, submitted the request to the Ombudsman's institution for the initiative of the procedure for controlling the constitutionality of Law No. 08/ L-196 for Salaries in Public Sector. The Council considers that the Law for Salaries in the Public Sector is contrary to the Constitution, with Law No. 06/L-054 for Courts, Council of Europe recommendations on the independence of the judiciary, the opinion of the Consultative Council of European Judges, and the Constitutional Court Act of Coron 2/03/19, therefore, the Council is asking the ombudsman to take in the framework of its constitutional and legal competencies necessary actions to address that requirement at the Constitutional Court”, the statement said.

Otherwise, the Law on Salaries in the Public Sector went into effect from February 5th.
