What if the Law ends up in Constitutional?
From the Kosovo Institute for Justice (IKD), they say they have prosecuted the Law of Salaries to the Ombudsman on January 6th and that it has demanded the same one within its constitutional and legal competencies to prosecute this law for assessment at the Constitutional Court
Gezim Shala from this Institute has talked about the Express Journal about the procedures following following the ombudsman complaints.
According to Shala, the ombudsman has the competence that within six months of entering into force the Law on Salaries in the Public Sector, he will proceed with the same assessment at the Constitutional Court.
And when the Law goes to Constitutional, Shala says this Court is likely to cancel only specific provisions of the Law, which are considered to be constitutional, unless they find that certain articles affect the entire Law.
According to the Constitution and Law, in this case, the ombudsman has competenced within six months of entering into force the Law on the Salat in the Public Sector, to proceed with the same assessment at the Constitutional Court. In the case of reviewing this Law by the Constitutional Court, this Court is likely to cancel only specific provisions of the Law, which are considered to be constitutional, unless they find that certain articles affect the entire Law”, Shala has declared for Express.
From the IKD estimate that the Law for Salaries in the Public Sector is a law that does not meet constitutional standards and that, for this reason, in this situation, the actions of the ombudsman are necessary.
