The director of the laboratory where Dehar's samples disappeared worked without a license

For almost 15 years, the Goga-Bayram butterfly is at the helm of the Toxicology laboratory under the Law Medicine Institute. Goga-Bayram, who was one of those suspended in connection with the disappearance of Astrit Dehar samples, is all this time turning out to have done jobs that are not allowed under the Law on Health.

This was found in a report that the Health Inspectorate is operating within the Ministry of Health. The report, dated January 13th 2023, has found that Goga-Bayram butterflies during the time they worked in this laboratory have processed the blood of living persons.

Goga-Bayram was selected by Justice Minister Albulen Haxhiu, as well as the director of the entire Legal Medicine Institute. It happened one day before Astri Dehar's samples disappeared.

Health inspectors have found that blood and urine processing is considered health service, which under the Law on Health requires license. The Health Inspectorate report says Goga-Bayram did not possess licenses for performing these jobs.

It has been found that Mrs. Flutra Goga -Bayram was employed at the Legal Medicine Institute on account of the Toxicology Labarators as leaders, where she even processed toxicological tests for corpses, but in special cases even living persons (the victims of physical and sexual violence) were processing blood and urine”, this report says.

Because blood and urine processing is considered a health service then Article 71 of Law number 04/L-125 Health has seen the licensing of health professionals according to the profiles set out in Article 69 of this law, while Article 71 of the Law states: The health professional can offer health services independently only after obtaining a key license, said further in this Health Inspectorate report.

Medium has tried to contact Goga-Bayram butterflies all day long to get a comment on the subject, however, she has not responded.

On the other hand, the Inspectorate noted that at the time the competition was announced, there was no job license required as a lab or a nurse. However, it has found that processing blood and urine for victims of physical and sexual violence requires licenses under the Law on Health. Since the Inspectorate has no competence to take any measures, the case was forwarded to the Justice Ministry.

“Based on the findings of the Health Inspectorate since Mrs. Flutra Goga-Bajram is employed at the Law Medicine Institute on death at the Toxicology Labarator and inspection data has been found to process/do the toxicological analysis of corpses, but in separate cases even living persons (the victims of physical and sexual violence), which is subsequently considered to be health service and to provide the same service must have one of the profiles specified under the 17th Sandient Law, and in the 71th paragraph of this 4th Law determines who can provide health services, therefore, that the other health ministry gets a license that takes on the course of action as such as a matter of justice, the state's report is to be submitted to justice.

Goga-Bayram butterfly is the leader of the Toxicology laboratory under the Law Medicine Institute. Astrit Dehar's samples had disappeared just in this laboratory. Goga-Bayram was also appointed director of the entire Law Medicine Institute. The disappearance of Astrit Dehar samples even occurred one day after Goga-Bayram was elected director.

What Do Laws Say?

Performing health services without a license, as the Health Inspectorate found in the case of Goga-Bayram, is regulated by the Law on Health.

Among the health profiles set out in this law is a high medical laboratory. This is arranged with Article 69 of the Health Law, which speaks of health professionals.

Article 71 of the Health Law on the other hand shows that licensing is done by respective Oda and health professionals. And paragraph four of this article says that health services can be offered only after obtaining a license.

The licensing of health professionals is done by the respective Oda of health professionals, in accordance with this law. The health professional can offer health services independently only after obtaining license”, the Law on Health says.

The law also envisions sanctions related to performing jobs without license from relevant health interests. However, in this case after the IML functions within the Ministry of Health, it has been impossible to pronounce a fine.

Other health institutions in these cases could be punished by between two thousand and eight thousand euros.

The health professional, on the other hand, is sentenced to between 1,000 and 2,000 euros in the event of working without a currency license.

This case has already been followed by Health Inspectorate at the Ministry of Justice.
