Eight charged with subsidies fraud, names

The indictment against the accused was proclaimed Tuesday by Judge Adnan Kamberi, reports “The Justice Act”.

According to the indictment, the defendants were acquitted because they have not proved to have committed the criminal work they are in charge of, while the temporarily seized tractor returns to accused Berisha.

Judge Kamberi has said that the costs of the procedure fall to the court's burden, while against this bias the parties have a fair complaint in the 15-day term after accepting the same.

Otherwise, Pristina Constitutional Prosecutor on April 26, 2019, has filed an indictment against Agron Berisha, Nexmi Hysen, Nasim Kastrat, Fatmir Tuka, Agim Noec, Ramadan Kosumi, Imer Lujasa and Muhamet Leci, who charged them with subsidies.

According to the indictment, on April 29, 2013, defendants Agron Berisha and Fatmir Tuka were charged with applying for a provision for obtaining a subvention shared by the Ministry of Agriculture, Forestry and Rural Development (MBPZHR), the defendant Berisha presents the competent body to this inaccurately provided ministry, which was condition for approval of the subvention that was 65% of the defendant's Business Plan, as it had submitted to the Agency for Development of Agriculture <1> The business-mechanism agricultural plan for the laundry sector and was pledged to purchase a tractor at the highest market price for land delivery of 133.25 hectares.

Then, reportedly in co-ordination with the defendant Tulla, owner of the company that deals with the sale of agricultural mechanization, tractors, Berisha had introduced A. The ZHB's tractor price bill worth 51 thousand and 900 euros, which for the same tractor the real value of market prices was 26 thousand euros.

Later, the prosecution says that by failing to abide by the conditions of the AZHB, using the subvention granted for other purposes, from what has been given, the tractor purchased by the subsidy granted by the MBPHR, the defendant Berisha has sent for sale to a firm that exclusively deals with the sale of tractors.

With this, Berisha and Tulla under the first device of the prosecution were accused of committing the criminal work “Substitute fraud” by Article 336, paragraph 1 and 2 concerning Article 31 of the Republic of Kosovo Criminal Code (KPRK).

At issue, the second point of the prosecution charged defendants Nedimi Hyseni and Fatmir Tuka, that on March 13, 2013, on the occasion of applying for the subvention shared by the MBPZHR, defendant Hyseni presents the competent body near this inaccurate data ministry that was conditional on the approval of the subventionary body, so that he had bought a subventional tractor of the type “TOmosanx1> at the price of 40 thousand euros, agricultural vehicles, as a price of 7 thousand euros, car worth of 165,000 euros for a pound, a car's worth of car worth of 65,000 Euros at the price of 65,000 euros, and 350,000 euros for the total carpth price of 65,000 euros in the total that is worth of $'s at the price of 72000 p.2000 p.2000 p.2000 euros.
