After announcing the first degree decision, where the court convicted them of obstructing official persons in carrying out official tasks, intimidation during the criminal procedure and violations of the secret of the procedure, they filed complaints at the Appeals.
At the first rate, they were sentenced to four and a half years in prison, where the time spent in detention will be calculated, and with a fine of 100 euros each. Meanwhile, they were released from criminal responsibility for revenge.
On 25 September and 26 September 2020, Hysni Gucati and Nasim Haradinaj were arrested in Pristina, Kosovo, and transferred to the DHSK detention facility. On December 11, 2020, Pre-Procedure Judge Nicolas Guillou confirmed the indictment against the two accused.
On July 16, 2021, the Judge of Pre - Procedure passed the case file to the Judicial Chamber II. Judgment began on October 7, 2021. On November 10, 2021, Z. The SP finished presenting its evidence. Both defence teams completed presenting their evidence on February 2nd, 2022.
The act was declared on May 18, 2022. The Judicial Chamber convicted the two accused of obstructing official persons in performing official duties, intimidation during the criminal procedure and violations of the secret of the procedure. Both indictees were acquitted of taking revenge. The Judicial Chamber sentenced each charged with four and a half years in prison, counting time spent in detention, as well as a 100-euro fine each.
Like Mr. Gucati and Mr. Haradinaj submitted appeals reports on June 17th 2022. In line with the procedure, DHSK Speaker appointed the Appeals Court panel, composed of Judge Michele Picard, Kai Ambos and Nina Jergensen. On July 5, 2022, conferences were held before the appeal, after which defence handed over appeals files. Appeal hearings were held on December 1st and December 2, 2022.
