The decision was made by Judge Charles L. Smith, who has concluded that the prosecution's argument is insufficient that Thaci and Veselin “can escape from justice” if left to defend themselves in freedom, but that they can prevent the management of procedures.
The panel has found that there is a sufficient risk Mr. Thaci can prevent the management of the DHS” procedures and he can carry out further “crimes against those perceived as opponents of the KLA, including witnesses who have offered or can offer evidence”, it is said in part in the ruling.
