Various sources in the MPJ have told “The Coha” that in the case of Brbatovci, promotion procedures that apply to other members of the foreign service have not been respected. A diplomat before arriving at the councilor's rank, the first to be given is a strike, then Secretary Three, second secretary, first secretary and then Councillor.
This mode of promotion defines Article 26 of the Law for Foreign Service, under which the main elements for providing a degree are service time, qualifications, and assessment of the results of work.
“1. The advantage of foreign service officials is done by relying on the promotion system. The main elements in providing a degree for the member of the foreign service are service time, qualification and assessment of the results of the work. 2. In addition to the ambassadorial rank, the degrees are provided by the Commission of Graduates and Discipline, on the basis of data that is found in each employee's personal file and based on estimates made, according to the criteria and regulations set out in the Order for Foreign Service”, says Article 28 of the law.
Until Brbatovci has offered no clarifications regarding the appointment, the MPJD has argued with him that the Law does not foresee restrictions on what is the first diplomatic grade. But no clarifications have been given as to what the results of the work on overcoming the degrees in the case of Brbatovci, which became part of the MPJ on the heels of the Diaspora Ministry.
“Based on the Law in force for Foreign Service, Article 28, estimates that career advancement is made on the basis of the promotional system and that the key elements in providing a degree for the member of the Foreign Service are service time, qualification and assessment of the results of work”, the MPJD” says in response to the MPJD. Under the Foreign Service Law, the minimum period for transition from one degree to another is determined with the relevant regulation.
The regulation completed for the 2009 foreign service stipulates that members of the foreign service have the right to apply for promotion or appointment in new positions after serving a year in positions in foreign service.
“1.1. The members of the Foreign Service, who have diplomatic or Consulial Grada, after serving 1 (one) year in positions in the Foreign Service, have the right to submit a request for the Marching or appointment to new positions, while members of the ministry who do not have the Diplomas or Consulates earn it right after serving 1 (one) at the minister”, writes on regulations.
Furthermore, it is determined that, the Commission meets once in autumn and once in spring each year, “and each other as necessary, to prove the appointment of degrees and to consider any case of violations”. The commission consists of seven members. Part of the Commission has also been the director general in the MPJD, which was down after the MPJD reshuffle. This dissector has not shown who currently participates in voting instead of the director of the Commission for Grada and how decision-making has been done in the Brbatovci case. Brbatovci's appointment was disputed even when the interior audience by Minister Grovall was appointed.
