Nothing has moved for the initiative to establish a supervisory body for the Special Court, but that it has not given up either. The justice minister insists that such an organ should be done but says it has an agreement to make that Parliament, unless the Special does.
The idea, shown a year ago that a supervisory body must be established over the Special Court, continues to remain an idea.
Named by the prime minister, the prime minister's deputy and justice minister, the initiative has not moved away, but has not given up on it either.
Minister Albulen Haxhiu says she has an agreement that this job will remain the Parliament as this institution has established the Special Court, except according to its goal it is not for the body to be from the executive, nor from the legislature.
I have the impression that the ombudsman there does not do the job properly. And I told that to the chairman at the previous meetings I had with the same person. Therefore, the idea has come up or the idea of having a mechanism, being the Special Court, although it is considered that it is Kosovo's, does not report to the Kosovo Judiciary Council, as regular courts in the Republic of Kosovo are common, so it does not report to anyone. And in this case I don't know any example of a court that has worked without reporting to someone”, has stated for RTV Dukagjin, Albulen Hadziu.
But, on the other hand, the attorney accredited by the Special, Taulant Hodaj, says the foundation of such an organ is problematic if the special does not agree with it.
He emphasises that there is only such precedent from the past, when The Hague's Tribunal has been monitored on several occasions by the UN.
The actual structures are contributing states or states of the European Union with the United States, because otherwise any legal initiative that changes the Office for overseer law will not be valid near this court that they have also given in the interpretation of the Constitutional Chamber of the Special Court, which they say is not worth any change that the Kosovo Parliament makes”, Hodaj has declared.
But the specialised rooms themselves don't seem to like such an idea.
Kosovo's “Special Court is a legal court and acts according to the agreed mandate between the EU and Kosovo, which is envisioned by the legal structure in the Constitution and the law adopted by the Assembly of Kosovo. The Court's legal framework defines fundamental rights and freedoms in the Constitution, and the Court applies international standards of human rights that are in line with the decisions of the European Court of Human Rights. As in any judicial system based on rule of the law, this legal framework also envisions independent judges, who are not under control or unjust influence by any executive or legislative authority”, the Special Response said.
The Special Judges in The Hague have the first degree -- the Court of Appeals, the Constitutional Court and its ombudsman.
