Should Serbia extradite Radociqi on the basis of INTERPOL arrest, his lawyer shows procedures

International police organization, I NTERPOL, issued a warrant for the arrest of former Serbian List Deputy Chairman Milan Radojic and 11 others over the armed attack on 24 September in Banjska in northern Kosovo. While Radociki's lawyer shows what further procedure is in this case. Lawyer Nenad Beqiriq, talking about “Noova“, [...]
Lawyer Nenad Beqiri, speaking of “Noova“, points out that if a red INTERPOL order has been issued for his client (Milan Radovici) does not mean it will be done immediately, the more politically sensitive situation for the state [Serbia].
For one thing, news of the release of INTERPOL's arrest warrant for Milan Radocicin is not enough to be precise, because it cannot be verified by what warrant the arrest is about. I NTERPOL may issue certain types of arrest warrants and only that red one forces the member state to arrest and extradite the fugitive. In the concrete case, even if a red order has been issued for the person mentioned, it does not mean that it will be done immediately, much more so that it is a politically sensitive situation for the state [Serbia]. What further complicates the situation judicially is the fact that an investigation is under way in the Republic of Serbia and that the investigation is likely to be carried out in connection with the same events his extradition is required, as well as the fact that he is under the ban to leave his residence”, says lawyer Beqiric broadcasts Telegrafi.
According to him, the issue of objectivity and impartiality, according to the laws, should be indisputable.
“If we adhere to the Constitution, criminal acts allegedly committed by Radojic are committed on the territory of the Republic of Serbia, so the jurisdiction of the Serbian prosecution and courts is undisputed. And the issue of objectivity and impartiality, according to the laws, should also be indisputable and if that's how it's going to be carried out, the lawyer remains to be seen”, the lawyer concludes.
Former Serbian List Deputy Chairman Milan Radojic has claimed responsibility for the events in Banjska on September 24th, when an armed conflict with the Kosovo Police occurred in the early hours of the morning.
On that occasion, Kosovo police officer Africa Bulnjak was killed, while three Serbs -- members of the armed group led by Milan Radojic -- were killed.
The international community and Kosovo authorities named that conflict “act terrorist”. On 24 September and the following days, Kosovo police found a large quantity of military weapons in Banjska and the district.
On the other hand, Belgrade's High Public Prosecutor has initiated a procedure against Radojicic for the case in Banjska. Serbian investigative authorities charge him with illegal production, maintenance, maintenance and trafficking without gun permits and explosives, as well as for criminally committing serious acts against general security, as well as with the intent of carrying out criminal work. He has been marked as host of the group.
