PDK shows why it sent the Law for Sovereign Fund to Constitution

The Democratic Party of Kosovo (PDK) has submitted the Law for Sovereign Fund to the Constitutional Court.

MP PDK, Ferat Shala, said the government through this law is attempting to impose a superstructure to create inequality and open other lines of control over public assets.

We are now starting this political process and we are convinced that it would have to be returned or surprised by this already adopted law and return to the country's economic normality, because this Government is attempting to deal with such uneven discrimination laws to capture resources, assets and enterprises, which de facto and de ju manage by”.

“The PDK estimates that with the Law for the Sovereign Fund, an institution is being established outside the principles of the rule of law, and the demand for the assessment of this law is unable to decree it on the part of President”.

While lawyer Faton Fetah said MPs from the PDK Parliamentary Group have since warned that such an initiative is unconstitutional, as some companies will submit to the company, thus creating legal and economic inequalities.

We have all calculated, we have estimated that 11 articles of this law are incompatible with at least 7 articles of the Constitution, and so is the article, which speaks of the investment role of the Sovereign Fund and the creation of companies, which are like private companies that will support the Fund”.

So this way it creates monopolies in the market, because the Sovereign Fund will choose two private companies at its will, unconditionally and without criteria, it will invest”.

This Law was passed days earlier in the Kosovo Assembly, with the votes of ruling party deputies. Even the LDK has sent this Law to the Constitutional Court with claims that “the government Kurti is willing to create a controlled state super-building”.

The Kosovo government has said that the Sovereign Fund will be a new and effective mechanism for investment orientation, improving corporate governance, establishing competitiveness and quality, increasing skills and employment, as well as eliminating misuse and corruption in the public enterprise sector.

According to the Government, the Sovereign Fund would take over Kosovo's strategic assets. The Fund will have exclusive responsibility for investments in the growth of Trepca's value, KEK, Thrill Corporation, PTK's. /EO
