Ex-partor of KLA, Nasim Haradinaj, has been acquitted of all counts of obstruction of justice in the Special Court investigations.
At the end of last year, Haradinaj was sentenced to 4 and a half years in prison, including the time of his presentation before the court.
This is the final decision of the Court:
Kosovo Specialised Chambers Chairman (DHSK), Judge Ekaterina Trendafilova, decided to modify Nasim Haradinaj's conviction for his release on December 14th 2023, or about this date, under conditions defined in the decision. These conditions will be in effect during the remainder of the sentence handed down by the Court of Appeals panel, specifically for the remainder of the four-year-three-month sentence.
In making the decision, the chairwoman consulted the panel judges who served the sentence as envisioned in Article 51é2 of the Law for Specialised Chambers and the Specialised Prosecutor's Office (“Law”), considered the factors of the 19650X procedure and Evidence Adjusts, as well as the session she held with Haradinaj. Also, as defined in its earlier October 12th 2023 decision regarding the reduction, modification or change of Haradinaj's sentence, the mayor also took into account the report delivered by the administration concerning Haradinaj's behaviour in the detention facility.
The mayor took into account that, although the criminal acts Haradinaj was convicted of are certainly grave, taking into account the very negative effect of uncovering confidential information on witnesses (possibly), were some factors that argued in favour of modifying his sentence.
Concretically, the chairwoman found that Haradinaj had the opportunity to reflect on his actions during his holding in the DHSK detention facility and on the basis of the report, he had respected the rules of the detention facility over the past months. Also, the mayor took into account Haradinaj's regret and his pledge that he would not be involved in other actions that could be characterised as criminal acts against justice administration and that he would meet all conditions set for his release.
The mayor stressed that if Haradinaj does not meet any of the conditions set out in the decision, then the decision will be annulled.
