Nagip Krasniqi rejects the request from Apel: Still can't get closer to KEK or to witnesses

The suspended KEK chief chief chief, Nagip Krasniqi, will not be allowed to approach the Kosovo Energy Corporation or random witnesses until another court ruling. The Appeals Court has rejected Nagip Krasniqi's lawyer's complaint against the decision to continue the move that prevents witnesses from approaching the case. Consequently, Krasniqi does not dare approach the Kosovo Energy Corporation.

News of the Journal Express has confirmed Krasniqi's lawyer, Virtue Ibrahimaga himself. According to him, Apel has not examined the complaints at all.

“Apel has rejected the complaint against the decision to prevent the approach of the workplace. The appeals court has not considered any complaints, but has only copied and established the prosecution's reasoning. Courts in Kosovo, with automatism, approve the prosecution's demands for measures, which do not occur in any other country in the region. This approach has also been criticised by the O monitoring report. October SB 2023”, he said.

For Ibrahimaga, it is unintelligible that the prosecution's request for Krasniqi to be barred from approaching KEK, since it says all witnesses have already been interviewed.

According to him, the prosecution filed evidence to prove its claims that Krasniqi committed criminal acts.

The procedure claims that Nagip Krasniqi could influence witnesses, but all witnesses have given their testimony before the prosecution. Based on the evidence gathered so far, the prosecution has no evidence to testify to its claims of criminal offence. Under normal conditions, the measure of detention of witnesses has to do with witnesses who the prosecution has not interviewed on the list. All these witnesses have been interviewed. The prosecution's request lists no new witnesses or witnesses the prosecution has not interviewed. The prosecution has had nine months to interview witnesses. Now without listing any witnesses it requires the continuation of the measure of halting access to work. This approach is not covered by the Law on Criminal Procedure. Through this approach, the Prosecutor, instead of a fair investigation, prejudges the epilogue of the investigation and deprives Mr. Nagip Krasniqi from the workwork exercise. The law protects the suspects through the presumption principle of innocence”, he stated.

On the other hand, the lawyer says the prosecution has no professional courage “to close the case”.

“In lack of transparency, the prosecution's intentions in this case remain questionable. The prosecution cannot intervene in public company management issues. The prosecution is tasked with prosecuting criminal acts, and in this regard, I must offer evidence for the elements of criminal acts. The prosecution, in this case, has no evidence of the elements of the criminal act, but it does not seem to have the professional courage to close the case when there is no evidence. This approach is useless and harmful to justice”, Ibrahimaga said.

What tender took Krasniqi to prison?

From the day of arrest, many reports have been circulated through the media regarding contracts that may have led Nagip Krasniqi, who was suspended from the KEK chief post after the arrest.

Initially, it was reported that the contract Krasniqi was for emergency repair of the A-5th bloc's thermal power plant Kosova A, worth 3.4m euros. The contract for this tender, which was granted under negotiated procedure, was signed on January 27th this year.

The restoration of this link was entrusted to the group of economic operators “Litin SA; Bujar B. Shala B. I”

“Demonisation jobs, cleaning and creating conditions for work, reviewing the pipe system and damaged equipment, and those under suspicion of damage, issuing specific equipment, assembly of new equipment, Sancing damaged equipment, Examing according to standards for welding in the 10%-by-ray, radiographing Commission, which means going back to work, and executing the bloc's operational tenders and handover of security papers to the report, were going to be done by this group of economics.

But, the Kosovo Energy Corporation had reacted to these reports, calling them untrue.

KEC had said this contract was terminated on March 20th and that no payments have been realised in favour of the operator.

“Contrata for “The emergency recovery of the furnace in A5” Block, was signed at the end of January of this year, but the same was interrupted by dt. 20.03. 2023 after the economic operator failed to meet contract terms under the signed contract (submitting financial guarantees for execution of jobs). It is therefore more important to note that KEK has had no financial spending, since no payment has been realised in favour of the operator”, KEK's response reported.

Although KEK had denied it, it was Krasniqi's lawyer who confirmed that his client is suspected of misusing official office for this very contract.

The criminal acts that Nagip Krasniqi was charged with allegedly using the official task for benefit to himself or anyone else. The prosecution-based doubt is the existence of contract with the Swiss Company to repair the furnace for the A5 block. This contract has been cut by 20.03.23 by Nagip Krasniqi himself. No payment was made. The prosecution is aware of this detail. No one has benefited. KEK has followed nothing. As it turned out about this case I can't exist criminal acts”, Ibrahimaga wrote on Facebook
