Emmerson's opposition is published: Wessel told visitors not to approach witnesses, prosecution hid this statement

Wessel's lawyer, Ben Emmerson, in the letter opposing the prosecution's wiretaps, has stressed that many of the conversations have not been presented to the panel and have been completely wrongly interpreted at the expense of Kadri Wessel.

“This is another and flagrant example of the SPS's reckless effort to present a deceptive view to the Judicial Chamber. This passage should have been included in the SPS request to submit evidence to the Judicial Chamber”.

The defence stresses that if they had not spent many hours listening to this large collection of audio recordings, convincing evidence would not come to light opposing the ZPS's primary parachute.

The fact that the SPO has buried this evidence amid untranslitured hours should be very disturbing for the Judicial Chamber”, says the defence, and quotes Wessel's conversation when asking not to talk to anyone who claims to be a witness.

Don't worry about it. [...] Stay away from this because you can hurt us; you can do us more harm than good. [ We can't be hurt, we don't have problems. In the remaining 300, none of them can cause harm. They may lie, God will deal with them, they can lie whatever they want, but don't worry at all, because they can then use this to make us look bad. While those people are cunning, they can do it, just to gain some kind of status there, to do something, they make it look like it was terrible. Let it be what it is! It's not a good thing to do. Keep your distance! Even if you've ever heard of someone coming to testify here; even if someone comes in and tells you “I'm [witter]”, you can just tell “tell the truth”, “just don't lie to”, just don't lie. There is no need to speak; we need nothing but not lie. If they don't, we'll be fine, because reality The KLA is like that. That's it. There's no need to be anything”.

According to defence, Wessel's clear message is that witnesses should not be contacted, and if intentional contact occurs, nothing more can be said to tell the truth.

This message is exemplary. It is extremely significant that this was a private conversation about which Mr. Wessel didn't know he was watching. It's very disturbing that the SPS could have heard this passage, failed to present it to the Judicial Chamber, and yet claimed that Mr. Wessel somehow conspired with [ REDAKUED] to frighten witnesses on evidence and implications merely circumstantial. Mr. Wessel with [ REDAKUED] constitutes a clearly expressed order against any attempt by anyone outside the legal process to approach a witness in any circumstance”, the defence writes.

Emmerson points out that the facts are clear. According to him, there is no evidence on which the Judicial Chamber can conclude that Wessel has attempted to hinder or intervene in this procedure. Rather, they feel that Wessel's private conversations reveal his ongoing efforts to prevent witness contact and to encourage witnesses to press forward and speak truth.

Many of the statements made in the request (to the prosecution) are deceptive, biased and include illegal speculation. They are neither adequately specified nor evidenced in any way by evidence offered and discovered by SPS”.
