Lack of wealth: The prosecution seeks Skender Hysen's sentence

Skender Hyseni is being charged with the quality of the state co-ordinator for Dialog at the Office of the Prime Minister, not declaring the type car “Volkswagen”, worth 13 thousand and 300 euros, owned by his wife, reports “The Law for Justice”.

Those statements, prosecutor Mustafa and lawyer Podvorica, were given Thursday in their final address, which they handed down in writing to the court.

Prosecutor Mustafa has said he remains on the whole near the indictment filed against Hyseni, since, according to him, Hyseni has deliberately failed to submit the required data on the form for the declaration of property in the case of taking over the state co-ordinator for Dialog to the prime minister's office.

“Because the defendant had knowledge of the purchase, authorisation for the exploitation of the car by his children, and has not verified whether it is still on behalf of his wife and has not requested information from his wife or children”, prosecutor Mustafa said.

According to him, Hyseni did not declare his type car “Volkswagen” worth 13 thousand and 300 euros owned by his wife, though the payment transfer was made through his accounts.

Prosecutor Mustafa has proposed to the court that Hyseni be found guilty and condemned by law.

On the other hand, lawyer Podvorica asked the court to confirm the provision of Article 363, paragraph 1, point 3, to free him from the indictment.

In a concrete case, my protector did not intend for the vehicle in question not to declare”, said lawyer Podvorica.

While, Hyseni had nothing to add to the final word, except he supported his lawyer.

Otherwise, on these charges, Skender Hyseni has been declared innocent at the initial session held on January 12th 2022.

While the Constitutional Court in Pristina has ruled on February 23rd 2022, it has rejected the request for impeachment of the indictment and objections of evidence exercised by the defendant's defender with the argument that the collected evidence provides sufficient grounds for well-founded doubt that the defendant committed the criminal act, which is placed on him and has grounds for establishing the current indictment.

Against this act, within the legal term the complaint has exercised defender Hyseni, lawyer Podvorica because of the substantial violation of criminal procedure provisions, the wrong enforcement of criminal law and the error and incomplete confirmation of the actual situation. While the Appeals Prosecutor has proposed that the defendant's defender's complaint be rejected as unfounded, while the complaining act be confirmed.

The Court of Appeals, on the other hand, has confirmed the indictment against accused Hyseni, while attorney Podvorica's request has been turned down as unfounded.

According to the indictment compiled in December 2021, Pristina's Founding Prosecutorship charges Skender Hyseni that in the form for property statements, he did not submit the required data, not declaring a “Volkswagen”, worth 13 thousand and 300 euros, owned by his wife.
