Rohde has added that good news in this report is that the legal rules in general are in line with international standards, while the bad news is that failure to implement the Constitutional Court's decision in Decani marks clear violations of the rule of law.
The “Experts term Kosovo a functional democracy and assess its modern constitution with strong guarantees for judicial independence. But they also point to sharp criticism of representatives and judicial institutions from politicians in senior positions”, the German ambassador on the “X” platform.
Rohde has added that the first two recommendations of the Kosovo report on rule of law are: 1. Freely implementing Decani's decisions and 2. The full respect for the independence of the judiciary, refraining from unnecessary criticism that undermines confidence in the judiciary.
In general, the report draws a mixed view, showing high legal standards that are not always fully implemented. It is very clear to me that urgent implementation as repeatedly requested by the international community, is necessary to successfully advance Kosovo's membership bid”, Rohde has written.
