Foreign Service Members Union Association announces legal violations at MPJD

According to the association's communiqué, legal violations are cited that the MPJD is making with the appointments to the ministry.

The announcement also mentioned the lack of appointment of directors in various departments.

MPJD legal violations: “Deputy Secretary General” more than 21 months, 13 departments without Directors and 9 divisions without Leader.

Part One Pristina, 16 November 2023 The Union Association of Foreign Service Members through this communique highlights concerns about the systeming and does not complete the workplace in leadership positions at the Ministry of Foreign Affairs and Diaspore (MPJD). Currently in the MPJD is a “Deputy Assistant Secretary General”, who illegally (without competition, set up in positions by several lower levels and the former Ministry of Unexplored Diaspora in foreign policy making), is appointed Secretary General of the Diplomatic Academy, and at once with the decision of Deputy Prime Minister/Minist of Foreign Affairs and Diaposa number 08/2022 of the 10.01.20.22, the replacement of the MPD Secretary General.

From January 10th, 2022, the position of “General Secretary” is “uscated” with “substitute “ ” contrary to all norms and preliminary legislation and the current one in force of the Republic of Kosovo (Law. 08/L-197 for Public Officials, Article 35). As a result, all decisions made by “Deputy Secretary General” after the 10,01.2023s have legal consequences. The usurping methods do not stop only with the position of the Secretary General, since for an almost two-year period at the MPJD in Pristina, according to Rule (ZKM) no. 012022, there are 13 key departments, but 6 of these departments don't have directors.

Without directors, there were also major areas and high-profile departments for the country, such as the “Department for Europe, EU and Rajon”, “Department for America”, “Department for America NATO and Security Policy”, “Department for Public Diplomacy”, “State Protocol”, “Department for Legal and Tactical Affairs” and so on. It is even more disturbing, but above all, outside any legal rating, centralising these key areas and of high importance for the country to the post of “Deputy Secretary General”.

According to the same rule, these departments have 31 divisions. Unfortunately, 9 divisions do not have leaders, yet recently 3 “Deputy Division Leaders” without competition, so without open competition compared to more competent colleagues and more work experience. This means that in addition to the fact that about 40 % of the divisions have no leaders, with the application of such methods, there is also inequality in work and careers, thus violating the basic principles of the country's Constitution. These found are just some of the irregularities encountered in the MPJD.

In the future, the Union will announce public opinion to find more and more apart.
