Former Serbian List Deputy Chairman Milan Radociq, who claimed responsibility for the terrorist attack on the village of Banjska on 24 September, when a member of the Kosovo Police and three members of the terrorist group were killed, has issued statements at Serbia's Interior Ministry and his lawyer Goran Petronivik claims he may be held responsible for possession of weapons.
However, legal experts with whom in Serbia think otherwise.

“If we still consider Kosovo part of our territory, then the prosecutorial actions in the pre-penal procedure should cover a much broader extent than non-licensed weapons. I think the main issue here is the death of four people and the injuries of some of our citizens, and then possession and possession of weapons without permission”, Niniq stressed.
He adds that if the “thesis of our state and of the prosecution is that the Brussels agreement is above Serbia's Constitution and that we have no jurisdiction on the territory of Kosovo, then Radoic can only be charged with weapons.

According to Article 348, paragraph 4, the penalty for that crime is two to 12 years in prison. Also, according to Article 391 of the Republic of Serbia's Penal Code, this kind of organisation of a paramilitary formation with heavy weapons is considered terrorism, which is sentenced to imprisonment from five to 15 years”, Stojkovic points out.
According to him, there is no doubt that under Serbia's laws, this armed formation represents terrorist organisation, because any armed formation that is not part of the Serbian army or police, with weapons so large and heavy, is terrorist.
Also, it is clear that during that group's action a Kosovo policeman has been killed, and according to Article 114 paragraph 1 points 7, this constitutes a serious murder, which is sentenced to at least 10 years in prison or to maximum prison sentences.
The group's “body organiser, promoter and assistant is punishable equally as the immediate author”, Stojkovic stressed.
