Prosecutor: It takes a little over 700 hours to present the case in Thaci's case.

During the preparation conference for the trial, in the case of Hashim Thaci, Kadri Veselin, Jakup Krasniqi and Rexhep Selimi, prosecutor Matthew Howling has said it would take a little more than 700 hours to present their case. He said that after being asked by Judge Charles L Smith II, who previously said [...]

He said that after being asked by Judge Charles L Smith II, who in advance said the court would make cuts if there is a need to respect the right of the accused as far as the length of the trial is concerned, reports “Justice Vought”.

He has demanded that the prosecution show the number of witnesses they want to call and that they have previously given a list of 323 witnesses and asked to be informed if they are all thinking of calling.

There's a number of witnesses on this list that we intend not to call, we'll rely on their evidence. Not all of these people can come here, but those who come are on the list. It is possible for witnesses to present evidence at the trial to make unnecessary presentation of later witnesses. Your instructions and expectations are clear. We're looking at witnesses from Rule 154 if we can reduce the time we're going to question”, he said.

Initially, prosecutor Matthew Howling has declared that they have completed the examination of excusing materials for all materials earlier this week.

He indicated that they are on the move to prepare in the next package, which has 15 materials in it and that there will be a demand for protection measures. Regarding this package, he said it is the only one preparing it.

As if we're pointing at our vision, we have no witnesses of the 153 rule in the first 40. For rule 154 we can do it for 12 witnesses by February 7th. For all witnesses, I want to say that we want to prepare something closer to the date, we're going to have to consolidate, we're going to be able to apply for witnesses from the next three months, at the same time that the material will be delivered in accordance with the 73x1> order, he said.

While Thaci's lawyer, Gregory Kehoe, has said that for the first 12 witnesses, he believes it will take two weeks.

And the prosecutor has said that for the first 12 witnesses there are dozens of materials and that they have no objection to responding to protection for two weeks.

The prosecutor has stated that concerning witnesses who have died and those who are not available are preparing the request and that at least half of them will submit their application by the appointed date.

The first half will be delivered by March 1st 2023”, he said.

Lawyer Kehoe has said he thinks there are about 32 witnesses, where some of the witnesses have been on other issues as well and have been treated to other judges at TPNJ and said they will need a lot of material to consider by March 1, 2023.

It is difficult to examine all these materials by March 1, 2023. They're taking considerable time. This is in line with all the other defence teams do. To do this, we need considerable time to respond to 155 documents within March 1,”, he said.

In addition to death certificates and medical reports, the prosecution was asked if there are other problems.

The prosecutor has confirmed that statements of the dead witnesses have been given protection and that there is no problem.

Defence lawyers demanded that a month be the deadline for answers to the issue.

Similarly, the prosecutor when questioned by the chairman of the court, Charles L Smith III, has said that they have no objections to this deadline for a month.

Attorney Howling said they were preparing applications for all the facts, so they'd be able to identify them all before trial.

Lawyer Kehoe has said that together they will submit an announcement of the facts deemed.

For the most part, colleagues agree on what the facts judged will be, there will be certain exceptions. But I believe we're on the same page”, he said, until other defence teams agreed.

On the other hand, lawyer Kehoe has stated that he wants to speak about the motion they made under the deposit they received from witnesses and have submitted on January 9th.

This motion is still pending, I don't know if it's part of the 117 category, but I'm raising it right now before the court is aware. Another one I'd like to raise is the possibility of talking about the issue of armed conflict and we've discussed it with each other, we've announced that we want to get this up with the SPS in this respect, we'll discuss this when we discuss this in detail on paragraph 7”, he said.

In addition, it was said that by the Administrative Office, there is no indifference to other demands for persons who want to be participating victims in the process.

No one has contacted us individually either through representation. There were eight requests received when the case was transferred, the Administrative Office is handling these. There could be a future. If the court sets a deadline for delivery of requests, perhaps this will spur”, he said.

The judge asked him if he thinks February 15th will be the significant date for setting the deadline, while prosecutor Howling said they are ready to begin the trial on March 1st.

“E knows the defence proposes to be at the end of March. We do not object to”, he said, adding that they want the trial to begin in March.

Lawyer Kehoe said they are ready to enter trial on March 1st, but have no comment on that.

Kadri Wessel's lawyer, Ben Emmerson, stated that there is basically no reason not to start on March 1st.

“We have an extraordinary working period this month that will probably create technical problems”, he said.

On the other hand, he said there have been difficulties for the point of contact in Kosovo, and some of these aspects could create obstacles, but that these are not predicted and he sees no problem starting on March 1st.

From Selimi's defence team, it was said that the incident that took place at the last session could have an impact on their preparation and that they want to start judging as soon as possible and that they would ideally want to start on March 1st.

He said they are dealing with the consequences of what happened at the last session and will try to begin on March 1st or near that date, as well as that there may be reasons that would cause obstacles and depend on the identity of 12 witnesses.

In addition, it was added that they wanted a break after the opening statements.

“to take a one week or 10 days break from the opening statement”, it was said away.

The defence also said they want the first 12 witnesses to have no witnesses directly talking about Selim so that they can prepare.

The defender of the victims, Simon Laws, said they do not seek delays in this trial and do not seek to postpone the 1 March date.

The parties have agreed not to read the indictment on the case of the start of the trial.

The prosecution said it would make an opening statement that could take six hours, while the defense of the victims said they would make entry words that could last 45 minutes.

Kehoe said they'd be making entry words after the ZPS, which would take 3-4 hours. Emmerson, however, said he will reserve for the right and may last 45 minutes.

From Selimi's team, it was said it would last less than an hour of their entry statements until Krasniqi's defence said it would last up to an hour and a half.
