The SPAK did not answer until the publication of this writing the questions BIRN addressed regarding the status of registered criminal prosecution against Mediu and whether the latter had been taken into custody and communicated the charges.
The reopening of the Media case was put into effect after 12 years with the initiative of the family of one of the victims of the March 2008 explosion in the environments of the former “Tankeve Brigade”, with 26 life loss and hundreds injured. According to researchers and SPAK, after the legal changes of 2012 and 2017, the MP no longer has parliamentary immunity for prosecution or trial, and there is no obstacle to the Media investigation.
The Special Prosecutor called for revocation of the 2009 Supreme Court's decision to drop the case in charge of the former defence minister, but this court succeeded the Special Court on the case, declaring the failure to investigate the motion.
The First Scale Special Court ruled the collapse of the SPAK's request for reopening the case and blamed the prosecution for failing to prosecute the prosecution for eight years against the former defence minister, arguing that criminal acts have been prewritten. This ruling was overturned by the Special Court of Appeals on September 24, 2021, which cleared the way for Mediu's proceedings.
