Dardan Krivaqias is ordered to undergo psychiatric examination

The general doctor at Ferizaj Hospital, Astrit Hoxha, said there were doubts about the condition of the accused, Dardan Krivaqa, because, as he said, of using narcotic substances.

That statement, Hoxha made Tuesday at the Ferizaj Foundation Court, where Dardan Krivaqa, along with Arber Sejdiu, is being charged with the violation and murder of the deceased, Marigona Osmani, reports the “Justice Trust”.

Defending the accused, lawyer Admir Salihu has questioned witness Dr. Astrit Hoxha, have you compiled a report on health control of accused Krivaqa, which was held on the day the hearings were held for the detention assignment, Dr. Hoxha said she has compiled the report and found that the situation of the accused Krivaqa was stable.

“I have had my doubts, I'm based on the medical report and on the psychological state of the accused Krivaqa, I just suspected I couldn't say that I was accurate”, Hoxha said.

Lawyer Salihu has asked witness Hoxha, whether it is true that the same one has issued two media statements describing the situation of accused Dardan Krivaqa, that the same one has a serious psychological state and is depressed, and that his condition was due to the use of narcotic substances.

In this regard, Hoxha said that he re-exerts that after controlling the accused, he has behind his doubts about his psychologically charged condition, but that no tests have been done for which he was not his area, so he said that what he stressed about the advanced psychological state should not be taken to base because it could be the wrong thought.

On the other hand, the defender of the accused Krivaqa, lawyer Admir Salihu, has proposed that Dardan Krivaqa become a psychological, psychiatric and psychotic examination by the Forenzic Psychiatry Institute.

I propose this examination is made for experts to clarify the state of emotional and health, given that elements of narcotic substances have been found at the scene, so I consider this very important in this phase of procedure”, attorney Salihu said.

Lawyer Salihu, has demanded that in the event of his proposal's approval, the court be tasked with the experts' duty to expose the criminal history of the accused Krivaqa and the medical report where the accused is continuing to be treated at the detention centre.

Prosecutor Valdet Avdiu has not rejected this proposal, while the damaged party's lawyer, Gazmend Rexhepi, has rejected the lawyer Salihu's proposal.

While the chairman of the court, Sahit Krasniqi has approved the defence attorney's proposal, Admir Salihu, so has ordered the Forenzic Psychiatry Institute to conduct the forensic examination of accused Krivaqa.

Under these circumstances, the next session was postponed indefinitely.

The judge of the case, Sahit Krasniqi on September 2nd, 2022, has made a decision under which he has rejected requests for dropping the indictment and objections of the evidence submitted to the defense of the accused, while indictees Krivaqa and Sejdiu were confirmed.

And on August 23rd 2022, “Justice Trust” has reported that defenders of accused Dardan Krivaqa and Arber Sejdiu, who are charged with the 18-year-old Margona Osmani assassination in August 2021, have sought to cast the indictment.

Otherwise, on July 14, 2022, the initial hearing has been held where Dardan Krivaqa has used the right to defend herself in silence, while Arber Sejdiu has been declared innocent. / BpD
