Prosecutor Begins Investigations against Martin Berisha

The Constitutional Prosecutor in Pristina has launched investigations into Kosovo's ambassador to Croatia, Martin Berishaj, for false property reporting. Such a thing comes a month after the Anti-Corruption Agency (AKK) has confirmed that it has handed over a criminal row to the Prosecutor.

The start of investigations on Berisha for Nacional have confirmed by the Founding Prosecutor in Pristina.

Asked whether there is a decision to launch investigations, the prosecution positively confirmed there is such a decision in the case.

Martin Berishaj, as he has consistently written, is being investigated for criminal nonreporting or false reporting of wealth, gift income, other material benefits, or financial obligations.

Whether the investigation into him will be expanded on other tracks is unknown.

Yesterday it was a month since the Anti-Corruption Agency had handed over criminal outcry to Ambassador Martin Berishaaj, after it was announced by Nacional for the same case.

Since the deadline for throwing out criminal charges, when there are no elements of the criminal act is one month, the Nacional newspaper has contacted the prosecutor, from where it has learned there is already an act of decision for the launch of investigations to Ambassador Berisha.

In April of this year, the Nacional newspaper was the first Kosovo media to report a major financial scandal in Slovenia, including Kosovo Ambassador to Croatia Martin Berisha.

The following day, Nacional discovered another Berisha scandal. The ambassador had hidden his property in declaring it to the Anti-Corruption Agency.

After this fact was discovered, Nacional sent several questions to the AKK address, announcing the Agency that Berisha had not declared his company in Montenegro with the name “M B Consulting” in the wealth declaration. Nationale had even taken care of offering evidence to the AKK.

About four months after this report, The AKK confirmed to Nacional that it has already delivered a criminal outcry to the prosecutor.

“After your information on 22.04.22, the Anti-Corruption Agency (AKK) has launched the preliminary investigation procedure”, said at the introduction of the AKK's announcement sent to Nacional.

On the other hand, all documents were said to have been handed over to the prosecutor.

“The case with all the accompanying documentation date 05.08.2022 with Penal Calamim has been forwarded to the State Prosecutor for further criminal prosecution”, the AKK's announcement to the Nacional newspaper says.

The Anti-Corruption Agency is grateful for your co-operation and encourages you to continue this co-operation even in the future”, the AKK's response to the Nacional.

But how much can Berisha punish?

Article 430 of the Kosovo Republic Penal Code for these cases envisions maximum prison sentences of up to 5 years, of property seizures, for undeclared value.

Fine, prison:

Every person who by law is obliged to make a statement of wealth, income of other property benefit gifts, or financial obligations, who makes false statements or does not present the required sentences in the declaration, is fined and sentenced to imprisonment of six months to 5 years. The fines pronounced by this article can be pronounced daily and can be pronounced until the headship observes the command, verdict, or almighty judgment subject to action. ”

A Slovenian television television, Planet TV, has reported that over half a million euros in cash have been delivered from Montenegro to Slovenia, while the role of the mule, or money carrier, has been carried out by Kosovo's ambassador, Mr. Berishaaj.

Slovenian television, in today's broadcast chronics, shows that in the UK Consulting accounts recorded in Montenegro, between 5,000 and 50 thousand euros have been poured into regular bases each month. Company's Only Owner MB Consulting, based on official documentation, is Martin Berishaaj.

Slovenian television has reported that part of the documenting provided indicates that the event in question was extended in 2019 and 2020.

The payments are conducted by the GEN branch for Serbia (power company) at the private UK Consulting company in Montenegro, with which GEN company has consultations. Monthly payments of 5 to 55 thousand euros a month, or a total of over half a million euros, have been realised.

What can be found is that in business registration records, MB Consulting, is the same number as Mr. Berisha, which he has at the Kosovo Ministry of Foreign Affairs and on his Facebook page.

“Television Planet has learned that the Montenegrin company (the owner is Berisha/Berishaj) was founded just 10 days before the first payment of money made by Belgrade's GEN company. ”

Slovenian media show that the thing that has mostly attracted the attention of investigators has been the fact that nearly 600 thousand euros from the MB Consulting company are regularly attracted to cash.
