Minister Albulen Haxhiu's statements considered intervention in justice system

The 11-year-old rape case once again highlighted clashes and disagreements between the Ministry of Justice and the Kosovo Judiciary.

And statements by Justice Minister Albulen Hadziu, who called for the dismissal of chief prosecutor of the Constitutional Prosecutor in Pristina, and other dismissals that were requested by Kosovo Prime Minister Albin Kurti after reporting on the case of rape that the minor daughter by law connoisseur is seen as interference in Kosovo's justice system.

The executive director at the Kosovo Institute for Justice (IKD), Ehat Miftaraj, says that despite the judicial and prosecutorial system, they are facing a lack of accountability and integrity, political leaders should be careful in reporting on these two systems.

Miftaraj says political leaders' reactions to the work of the two councils will also be identified in this year's progress report, which they will consider as intervention in the work of the prosecutorial and judicial system.

It is a fact that the court and the prosecutorial system are facing years of lack of accountability, professionalism, lack of integrity and, most importantly, these two systems have built up the culture of impunity for prosecutors and judges who, even in cases when they are in conflict with law and do neglect in their work, and in cases where they limit the rights and freedoms of Kosovo citizens do not receive a meritive response. ...The division of powers is regulated by the Constitution, so neither the minister nor the prime minister nor the deputies nor any politician who in the distance judges the judicial system and the prosecutorial system are allowed. This Kosovo Constitution alone does not allow that, so politics should be careful not to further damage the judicial and prosecutorial system in its vocabulary. I am convinced that both this year's Progress Report and other international credit reports will identify these as interventions in the independence of the judicial and procrousal system, and there will be another attack that is lowering and lowering public confidence in the justice system and prosecutorial”, Miftaraj said.

And Justice Minister Albulen Haxhiu's request for the dismissal of Pristina's chief Constitutional Prosecutor's Prosecutor, according to Miftaraj, would be welcome from civil society and the public, but not from the justice minister as well.

“Absolutely is a lot of legitimate demand if this request comes from the public, civil society, on the part of prosecutors and judges within the prosecutorial system, but the same cannot and should not come from the political side because as judges and prosecutors have been barred from commenting on political processes passing the Republic of Kosovo, the same policy has been prohibited from commenting on the judicial procedures that are being conducted”, Miftaj stressed.

Even the Executive Director of the Foll Movement, Meddition Demolli, the latest statements against KKP and KDR, regard them as intervention in the justice system.

According to Demoll, these clashes serve neither side.

“Definitely not good are not serving either side. The independence of the judiciary is also guaranteed by the Constitution, and as such politics should stay away from the judicial system. We understand very well that there is a need for changes in the justice system, but these things should be done through drafting policies and laws and not direct attacks what we are seeing recently... are direct interventions in the judicial system, resignations or dismissals, whether the KRK or the KPC have the competent organs in the way specific prosecutors and judges are appointed and no one is appointed or dismissed with demands by politicians, whether by the justice ministry or the prime minister, Demoll stressed.

She demanded that politics stay away from these meetings that political leaders have addressed to the KKP and the KDR, but to make reform through law drafting.

The policy will have to stay out of the judicial system for them to finish their work, while the Ministry of Justice and the Office of Prime Minister through drafting the law aim to make the required reform, not through public exercise as we are seeing the last days of”, she stressed.

We remember that differences between the justice ministry and the Kosovo Judiciary and Prosecutorial Council have also emerged in the process of self-using. The councils have rejected this process, whose documents have already been submitted to the Kosovo Assembly.
