After Periscop reporting, AAC's Labour Union reacts: Director Bujar Ejupi adjusted the tender for his friend

Periscop has reported on Thursday that AAC requested an expert through tender procedures, and the Central Procuration Agency. i - AQP, which is responsible for developing joint procurements for contracting authorities. AQP does procurement activity for AAC as well. A few weeks ago, it has taken over to carry out the procurement activity “expert engagement for the Kosovo Civil Aviation Authority”. Periscope has found that the AQP has limited competition by creating discriminating circumstances, or by adapting the criteria for a certain company and thus favouring it during the tender profit race.
The AAC labour union has reacted today, throwing doubts about the adoption of tender conditions and conflict of interest. The response was published on Facebook page. After a while AAC has issued an explanation.

Civil Aviation Act Article 24.3, which the tender file quoted, says: “so that key positions related to aviation in AAC can be met with persons with relevant qualifications, AAC can produce (blea) services of up to nine (9) professional and/or technical experts to fulfill these positions through a procurement procedure that is in full accordance with the Public Procurement Law in Kosovo (x1LILILILIN for Procument”) as well as other conditions ahead of paragraph 2 of this law. ”
So this paragraph requires that the requirements for regular positions AAC needs can be used to meet these. Article 24.3 is interconnected and built on Article 24.2 (so regular employment, for example. If wages are not competitive, so that if they cannot be met, Article 24.3 can be used.
However, the procurement positions in this procurement process are not at all in the AAC organ and the regulation for the internal organisation of AAC.
At the beginning of the tender file, it is stressed that the purpose of this procurement activity is to cover the positions which have been demanded years in a row by AAC, but have not been approved because of the budget. It is true that AAC has been demanding additional staff for years, but these two procurement positions have never been identified as deficit in AAC as well as not in organogram, internal organisation regulations, or scheduled for recruiting in AAC before this year.
The AAC does not lack the expertise that has been requested in the tender file, and it is mismanagement of public funds to require experts for reporting or work that are part of the AAC staff's performance description that maintain regular labour contracts.

The winner of the Lot 1 tender is? Together they worked at Pristina International Airport “Adem Jashar” (ANP) and later at the Air Navigation Services Agency (ASHNA), where they were named v. Directors together in May 2016, appointments that had resulted from illegal KPC 10 months later, so they also left together. Instead of professional experience which doesn't show what it should be, because AAC already has more clearly prepared staff than Shilek, management experience has been requested, which Shilek has. In AAC, we have experienced aviation staff over 20 years and managerial experience.
Professional AAC officials have 10-20 training training from aviation training institutions in much closer areas, while AAC's professional collective community has hundreds of professional aviation training. So, would you like to help oversee the institution like the <x0 possible aviation expert, one person? Ejupi also for no reason has limited training to just three possible training centers. With a single professional field training this person will monitor and evaluate all technical departments, while no professional in AAC has the level to feel competent to cover all the tasks given to “Aircraft expert” produced here. Furthermore, management experience (3 years) has been requested, much more than professional skills, with the challenge clearly noted the adoption of this tender for Schelek.
Other abnormalities are noted in the tender conditions. The expert aviation person is expected to oversee the AAC's work, confirming that Mr. Ejupi does not feel competent about his position, but this person will oversee seemingly more professionally prepared staff than himself. It also notes that this person will perform executive tasks within the AAC, which is already carried out by existing staff and departments in AAC (mainly the Department for Security and Quality), but also other technical departments individually) or tasks which Mr. Self - awareness has degraded them (e.g. Testing security data, management of projects, institutional co-ordination, etc.
It also notes that the person ranked first in the other position, Tringa Mullaademi, worked at the NGO “K S-Kosovo” and the company “Mister” along with Bujar Ejupi. Another Ejupi friend, now AAC board chairman Skender Halili, has worked in the same NGO. While the other candidate for the location of “aviation user” Istog lives (who has migrated and now works in Australia) is a colleague from ANP and a friend of Ersen Silech, who is an indicator of having been coordinating the tender.

From the above, it can be concluded that procurement of these positions is contrary to the Civil Aviation Law (Nani 24.3), is not intended to assist management, and it is a devised tender by adapting conditions and tenders for friends of AAC Director Bujar Ejupi.
The Independent Union of Civil Aviation Authority invites justice bodies to investigate the procurement of these two positions in AAC.
