The Tirana court has recognised on Friday “Democratic Party's” ownership of Sali Berisha and his supporters, deepening the crisis further instead of resolving it.
In the decision handed down by Judge Agron Zhukri, acts of the DP National Assembly held on December 11th 2021 by the Democratic Party's Refounding Commission group are known. The census of the assembly held at the national stadium opens the way for the speaker's officers to take the party's stamp, enter the official building and eventually run the DP until it elects the new leading forums.
But in fact, the situation does not seem so simple. Because the part of the leaders and deputies that has left Lulzim Basha behind is strongly opposed to that decision. At the center of the controversy stands, Agron Zhukri, the judge who took it. According to the objectors, this judge who has not passed the caring is in pure conflict of interest, because his wife was Sali Berisha's secretary. Media close to Basha's group have even issued a document in which Zhukri seeks to withdraw from a process in 2018 between Rama and Berisha, using the conflict of interest as arguments.
In the published letter, Agron Zhukri poses a resignation from the issue, writing that his wife “Rrezarte Jrukri (Kui) has been a personal secretary and chief of Sali Berisha's administration, also a member of the Democratic Party, and is in friendship with him”.
With the same motive Zhukri wanted to give up this process, but his request was rejected by the Tirana court.
Starting with this match, Gazmend White attacked the judge the day before the harsh decision. He charged that he was influenced by an MP near Berisha and threatened him:“if the judge has decided to blow himself up, is free, has told the prison”.
The same stance has been taken by DP Commander Enkeleed Alibeaj, following the verdict's proclamation, calling it invalid: “In excess of the law, the judge has considered the matter. We have made a complaint about the December 18th census and the issue is on appeal. Today's judge had no record. The judge has made a decision without evidence, without a file, without a pair of”, Alibeaj said.
But as prejudiced and a party as Judge Jhukri, he has made a decision that is in the same line as the public has seen with his own eyes. The Assembly, gathered by Berisha on December 11th, had the support of most members. It was the product of voluntary signings of delegates, and any attempt to ignore it would be scandalous manipulation.
But does this verdict of justice resolve the crisis in the largest part of the opposition? The first signs seem not. Because the signals are that he can serve as a new apple quarrel for running, headquarters and the PPS seal.
According to Berisha's supporters, the court's decision is un appealable and what Basha called the mayor is considered fired, the stamp they used is nul, and the usurpers must hand over offices. Lawyers of the refounding commission claim decisions to register changes are decisions made without opposing parties, no complaints are allowed by parties that are not under way, and decision efficiency takes effect immediately.
The DP Refounding Commission's legal representative, Ivi Kaso, immediately after the ruling was issued, made an exhibition of how he read it: “From the moment he was announced, he has entered into force. The DP will now be governed legally by the Refounding Commission. There is only one DP, only a symbol adopted on December 11th, only a flag and seal that we immediately deposited after December 11th and the court recorded. The court recognised the highest body, the Refounding Commission. The decision is immediately executable. As soon as our request is accepted, we don't need to make vain complaints”.
But, on the other hand, it seems that Alibeaj, Whites and Company, so all those who are holding offices even after Basha's departure, will not recognise this court decision. Unlike the speaker's side, they claim that the decision is shaped to wait only after the appeal. Asked immediately after the court's decision on whether to free the headquarters, Alibeaj replied:“The decision is valid and applicable only when considered in the final instance that is Apeli. This decision today becomes executable if it is not complained or complaining, and the Court of Appeal examines it” he said calling it a nol decision after “we sought to make parties in the process, but they did not give us the answer to the decision is nul”.
Clearly, then, instead of solving the crisis, the court's decision has been equivalent to the parties in previous accounts to guard each The PD that's in its head.
