After the new year is set for the resignations of Serbian prosecutors, KKP also talks about Pantic case

Kosovo Prosecutorial Council head Jetish Maloku, at the annual media conference, where he presented the one-year job of the KKP, has commented on the change in security measure for former Serbian police, Dejan Pantic. He said it is not the prosecutor's responsibility to ensure the Pantiqi's behaviour to justice organs. During this conference, Maloku said [...]

During this conference, Maloku said that in 2022, they have scored efficiency in combating corruption and economic crime, while as the challenge for the institution, said it was the decree of Chief State Prosecutor for what he said was the president's responsibility, Vjosa Osmani. As a challenge, he also cited the decision to cut salaries for prosecutors.

While, he said, with concern they have seen the government leaders' reactions face that decision.

The “in terms of not achieving this suspect we don't think is responsible for the prosecution, are the relevant institutions that bring them in and secure the person in question... As for these reactions that have emerged, you have certainly accepted a reaction of ours, we have expressed the concern and opposition of any intervention we see from the power or state representatives, whether in the prosecutorial and judicial system”, he stressed.

As for the resignations of Serbian prosecutors, Maloku believes that after last year's holidays, he will make merit decisions on those resignations.

He stressed that wages have already been suspended for these prosecutors.

The “has been and it's a beautiful situation for us not very pleasant and the Constitutional Prosecutorial complex in Mitrovica has behind the most severe consequences even because of the lack, but also the administrative staff we like the Council have decided that these resignations we treat not as the resignations that have immediately offered these 10 prosecutors but we've decided to treat each other separately, and after an analysis we would have decided with merit decisions that meet the council is under consideration and right after the new year I believe that an analysis will be done to all the pleas of these resignations that are not quite quickly changing in the same way that we will decide with those resignations, he stressed.

The head of the Kosovo Prosecutorial Council has once again voiced objections to this institution's process of vetoing.

According to him, this process of constitutional changes brings no benefits.

We don't support a process of classic self-saving as we say because we think there are more consequences than the prosecutorial and judicial system does, and I don't know what benefits the citizen if there's self-inflicts that have more consequences than the benefits”, he stressed.

The leader of the KPK said that during 2022, they have drafted the strategic plan of the 2022-2024 prosecutorial system and five regulations.

And this same year, according to Malokut, the Council has developed all procedures for electing the chief state prosecutor.

“The KKP has drafted and adopted the strategic plan of the 2022-2024 prosecutorial system, the plan presents the main framework of policy planning for managing Kosovo's prosecutorial system in the next three years. The Council during 2022 has drafted and adopted 5 regulations dealing with the management of subjects through the SMIL programme, the selection of the director of the KKP Secretariat and the entity... The Council is in the process of reshuffle of the prosecutorial system administration with the aim of establishing professionalism and efficiency at work. During the reporting period, the Council has conducted all procedures for electing the state's Chief Prosecutor and the most successful candidate has decreed for decreeing the country's president”, he stressed.

KKP leader Jetish Maloku during this closing conference listed the challenges he faced this year.

He said the decree of the chief state prosecutor and the decision to cut salaries have been challenging for the prosecutorial system.

This year's KKP has accepted a total of 9 requests for the start of disciplinary procedures against prosecutors, until 17 disciplinary decisions have been issued.

KKP leader Jetish Maloku said they have also praised prosecutors' performance for 61 prosecutors, of whom 28 are well rated, 32 with sufficient levels and 1 prosecutors with insufficient levels.

“During 2022 The Prosecutorial Council has accepted nine requests to start disciplinary proceedings against prosecutors... during this period the Council has issued 17 disciplinary decisions, including those delivered from the year2021, it has issued four non-resigned public remarks, including 3 written public remarks including 2 agreements, 3 decisions for permanent transfer to other prosecutors, four decisions where prosecutors have been released from responsibility 1 has been suspended until the end of criminal procedure, and another case 1 has been established the investigative panel, and this is under consideration above”. He stressed.

According to Malokut, the Kosovo Prosecutorial Council has scored results and efficiency even in fighting corruption and economic crime.

“During the 9-month period of 2022 out of 380 accepted corruption cases has resolved 272 cases or 72% of cases accepted in terms of corruption from 303 cases admitted have been resolved 224 cases, respectively, of accepted cases. There is no doubt that reports indicate an efficiency in tackling corruption cases and economic crimes”, he said.

The leader of the KKP said that during 2022, 7 people have started working as prosecutors, while another 22 are expected to be added to the system next year.
