Prizren prosecutor seeks to toughen detention sentence on Vetevendosje MP

The Constitutional Court in Prizren on May 17th 2022 has declared a conviction act against indictees Islam Thaqi and Jetmir Vrenesei for misuse of official office, where they had been sentenced to 3 years in prison and two thousand euros in fines.

While the other indictees in the case, Erzema Morina-Tadic, Arrian Taraku, Is Bislimaj, and Albania Krasniqi were acquitted.

Against this act, according to the judges referring to the Appeals College, Judge Dzevdet Abazi, the complaint has been exercised by the Constitutional Prosecutor in Prizren, where the prosecution holds that the indictment must be changed and the accused are pronounced harsher sentences.

As for the liberation part, according to Judge Abazi the prosecution did not agree to that part, since he considered that the first-degree court did not take into account all the evidence.

On the other hand, Judge Abazi stated that the Appeals Prosecution has proposed that the Prizren Constitutional Prosecutor's complaint be approved, amended the complaint, and the other indictees found guilty, while in the case of the verdict on the complaint to amend even the most severe sentence against the accused.

Prizren's Constitutional Prosecutor's complaint and the Appeals Prosecutor's Proposal has backed the damaged party's representative, lawyer Taulant Hoda.

As for the indictees who have been released, according to lawyer Hoda the first degree court has come to the wrong conclusion regarding facts and evidence.

“Because the evidence that has been administered in this trial and recorded in the court act, clearly confirms their responsibility because with the same evidence two other indictees have been found guilty and testify that by their one-on-one actions the same have participated in the decision to destroy the private object that was in the legalisation procedure”, the lawyer Hoda has said further.

According to him, the same have deliberately committed criminal acts and at the same time have caused considerable damage to his client.

We consider that there is wrong confirmation of the actual situation, substantial violation of criminal procedure provisions and violation of criminal law, so that this court in the case of the pronunciation of this part takes a guilty plea”, he said.

While, in connection with the guilt of the accused, lawyer Hoda has considered that the Constitutional Court has justly proven the actual situation, but in terms of criminal sanctions, he said the minimum sentence it has pronounced is not appropriate for criminal work for which the same was convicted.

The same said they remain close to the legal property requirement.
