A few minutes from now, he has started sessions at the Special Court, where the decision will be announced for former Kosovo Liberation Army member Salih Mustafen.
At the beginning of the session, Chief Judge Mapie Veldt-Foglia said that “this bias is publicly pronounced in the name of the people of Kosovo and in the presence of Mr. Mustafa.
He further said there are misconceptions that “those charges were brought against the Kosovo Liberation Army or all the people of Kosovo”, adding that criminal responsibility before the Specialised Chambers is only individual.
“First, it seems there are misconceptions that these charges were brought against the Kosovo Liberation Army or all the people of Kosovo. There's nothing beyond trueness. It was the people of Kosovo, who through the Parliament, chose to create and to grant authority to this institution. Also, criminal responsibility before the Special Chambers is only individual”, she said.
Mustafa is accused of arbitrary detention, cruel treatment, torture and unlawful murder.
These crimes were allegedly committed at the 2003 detention complex in Kosovo in April 1999.
