Gruda: 1600 people will be laid off with the Law on Public Officials Salaries

Justice Department Co-ordinator from this party Progress Gruda said these two laws are marked by numerous violations of the Kosovo Constitution, human rights, as well as violations of the obligations Kosovo has made against the European Union.

Gruda stressed that with the Law for Public Officials, 1600 public officials will be released, and according to him, the government in power will thus employ its own people.
The law for public officials has some serious defects. This law got 1600 people out of work in Kosovo, if this law goes into effect 1600 people working in the public sector will be left without jobs. Their positions will appear in public contests, when they appear in public contests we know how people from this government are employed because we have experience. Family employment and politics no longer hide on the surface have become the norm. The second positions of all these officials are done on a four-year mandate, so they become a mandate like political staff, which would be the destruction of the administration. It could be the interest of the ruling party today to put 1600, that's the point, even in the interest of a party that can come tomorrow. They can't get out of work this way, it's a violation of their constitutional rights”.
He said the Law for Salaries is an unprecedented case because this law has been adopted without knowing the value of the cofficiency. According to him, the cofficient with this law would be appointed by government decisions.
In the case of the salary regime, we are dealing with an unprecedented case when the salary law is passed, and neither do they know how much the salary is. It has been left to allow the cofficiency to be decided through a government decision, effectively that the salary of any working in the public sector is not determined by this law, given by government decisions that assign coefcent. This violates the principles of the rule of law involving pre-presability, transparency, and we believe that the Constitutional Court will be on the same line in our opinion. Also, with this law, judges and prosecutors' salaries are lowered. This law also conflicts with the Law on Courts and the Law on State Prosecutor”.
The other “Defect of this law is that certain public servants are being discriminated against, public officials in a small municipality will receive less pay than public officials in a large municipality”, he said.
He added that all these findings and all the arguments the European Union Office has told them will be sent to the Constitutional Court next week, EO reports.
“You cannot violate EU calls and apply in the European Union, that is ridiculous. According to the Constitution we have eight days to send this law to the Constitutional Court, so we will send it over next week, I believe in the last days of next week, we've started working to analyze the case, and it may be between maybe, we'll send it through the deadline. We expect the Constitutional Court to decide to bring these two laws down”, he said.
