After much procrastination, the Kosovo Assembly had elected the chairman and four members to the Procuratory Organisation Board (OSHP), which is otherwise known as the Tender Court. 61 majority deputies had voted in favour, while opposition parties had released the hall earlier, following the fall of the Trust Bill.
The board's chairman was elected Vjosa Gradinaj-Menjuni, while members Nita Bata, Kimete Gashi, Vedat Peterqoj and Agon Ramadani.
Nita Bata resigned several days ago, leaving the board with four members. This has been confirmed by the Procuring Agent.
“Nita Bayta has resigned from post of O Board member A month ago. Her reasons have been personal. The same has stated that there are other commitments, and since the position of the Board member takes a lot of time and the commitment cannot bear this position for long, so it has considered it best to resign.
Immediately after his resignation, O Chairman The EPS has announced the Government and the Assembly, which we believe will in a timeline as soon as they meet Mrs. Batita”'s vacint position, says O'S response. DSA for Periscope.
Based on Public Procuration Law, O member contest The EPS should be opened by the prime minister's office and then names sent to the Assembly for voting.
In the prime minister's office, they have said they will meet this absence, but have not indicated whether to open the contests, or send a name to the assembly without competition.
“The EPS after Mrs. Nita Bata, we announce that in accordance with Law No.04/L-042 for Public Procurement in the Republic of Kosovo, complete and changed with Law No. 04/L-237, Law No. 05L-068, and Law No. The government of the Republic of Kosovo will propose for approval of the Republic of Kosovo candidate for member of the OSHP”, the Office for Public Relations of the Prime Minister says.
Periscop had reported that two names voted by the Parliament They were not part of the OSHP board and chairmanship competition. It's Nita Bata and Agon Ramadani.
The government on December 10th, 2021, had announced competition for chairmanship and four members of the Procureing Organisation Board.
On January 12, 2022, according to decision No. 0354, the government has established the Election Commission for recommending candidates for chairmanship and four members of the OSHP board. A total of twenty-five candidates had been applied in this competition.
On January 20, 2022, the Electoral Commission had submitted the work report to Government, where it praised candidates who had applied. Candidates have been assessed and targeted taking into account work experience, the CV and the motivating letter. A total of twenty-two candidates had passed that assessment, while three had not been posted at all.
The Election Commission had compiled the list with twenty-two candidates.
Having this list of names, the Government has decided to add to the list three other names, which were voted by the executive for further proceedings. So the government has ruled out competition procedures. Two “parachutists” have also resulted in a vote from the Parliament.
The Procureing Organisation is an independent administrative body and is subject to the Law for Administration. Decisions made by O The reports are:
Decisions on Procure Review

Against O Decisions The EPS is not allowed to complain, but the disgruntled side with the application could address the Foundation-Department Court on Administrative Affairs in the term of 30 days from the date of the decision's accession.
But the surrender or result of OE's request for judicial review under Article 119 of the LPP will have no further impact on implementing the corresponding procurement, except for the composition of the plaintiff's economic damage.
