He stresses that with only four special prosecutors it is difficult to investigate the first crimes of more than two decades.

The special prosecutor stresses that the first acts of trial in absentia are all for sexual assault. The trial in this form occurs for the first time in Kosovo and can only be prosecuted after five invitations are sent to the relevant state and announced in search of criminal proceedings for at least six months in the official newspaper.

I personally have four such subjects and, with the six-month deadline required under their law-scaling in the official newspaper, I will only start with the pre-trial acts in absence. She further says Serbia has not shown readiness, nor has it co-operated in the prosecution of these criminal acts, meanwhile it suggests that the Special Prosecutor has sought arrest for several cases, for suspects that occurred abroad.

“Establishment of the indictment and lack of judgment represents a satisphation for victims. On the other hand, it also presents the record of crime and the conclusion that crime has occurred. I, as a prosecutor, am not happy to carry out the procedure without the defendant's physical presence.

However, in the situation when we look for and take all possible measures for his finding and we fail to find him, then there remains this option, which represents a very important satisfare for war crimes victims”, she points out.

According to her, local prosecutors from obtaining competencies have achieved more successes than the two international missions after the end of the war.

After EULEX's acceptance of competencies, until today we have managed to establish a total of 13 counts of war crimes. Which means in these 13 counts are cases when we have managed to ensure the physical presence of perpetrators of criminal acts. Because by the year 2019, we haven't had access to trial in absence of”, the special prosecutor adds.

The crimes committed during the recent war in Kosovo are being investigated by only four special prosecutors.

There are these possibilities right now, consider the Special Prosecutor's competencies, which we have very specific competencies and process the most serious cases possible, such as: Organised crime, terrorism, corruption at the highest level, money laundering, all these are serious cases that require hard commitment. At the moment I can freely say that the number of prosecutors is not enough, in the hope that other prosecutors will come in the future, says she.

However, prosecutor Drita Hajdari stresses that they have set the priorities of war crimes cases based on the number of victims and consequences.

“Priories are the biggest massacres that have occurred in Kosovo. The priorities are sexual violence during the recent war in Kosovo. I can say that each case is active, but the priority is that we have given importance to the most serious acts of war crimes, as well as to those that can be done more easily, for which we have tangible and sufficient evidence that we can provide from the police, the unit for investigating war crimes”, she claims.

Special Prosecutor Drita Hajdari shows that she is currently investigating crimes committed in the Meja massacre.

“We have identified a large number of perpetrators of these criminal acts, even a number of persons according to command responsibility. We're in the witness interview procedure, and there's a lot of work in this case, but I'm optimistic that it's going to end by”, says prosecutor Hajdari.

Currently, there are over 60 cases of sexual rape of women and men from Kosovo during the recent war.

As far as sexual violence is concerned during the last war, we have a total of 64 cases, among which there are several men represented as victims of sexual violence. In all cases, including these cases of sexual violence, we are able and able to commit adultery when we find it, ensure the physical presence of the accused. Otherwise, until we had the Law on Judgment in Mungea, our only chance was to collect evidence, document the crime even to suspend the procedure. Waiting for the finding of the accused through international literature”, Hajdari says.

Kosovo institutions from UNMIK and EULEX have inherited about 900 matter and two thousand more for the missing.

In the Kosovo interview for Kosovo, Hajdari stresses that Kosovo is losing even many witnesses, the evidence that would be very easily ensured after the war ended.
