The indictment refers to a statement by Durmish given to the media, where he had said they have thwarted the plans of many designated groups that have benefited millions from the Ministry of Infrastructure, even mentioning Sami Lushtak's name, reports the “Justice Voughty”.
Lushtaku points out in the indictment that Durmish's statement has caused moral and dignity damage and that the same has deliberately attempted to expose him to shame in his community.
Contrary to the indictment, dated June 22, 2022, it is said that indictee Hurmish on June 8, 2022, in an interview held on television channel ATV, he made a statement saying: We've been ruining plans for many designated groups that have benefited millions from the Ministry of Infrastructure. There was one example, I think who these might be: from Sami Lushtaku and the people around him to Ramush Haradinaj and his men.
Here, Hysen's statement was quoted saying: So, what we're talking about here is two private companies have made a bill of about 30 thousand euros, but only with the maintenance contract, we have 30m euros in budgets. Somewhere we've been finishing these 14 tickets, we're spending 9m euros, for 3 years running 27m euros, 57 has been in government and government, 30m euros have been spent somewhere.
The indictment reportedly said that Durmish has unilaterally continued: “does not know whether they have gone into Lushtak's pocket or Ramush Haradinaj, but that have gone into Sami Lushtak's people's pockets and Ramush Haradinaj I am convinced”.
According to the indictment, Lushtaku claims such a statement will negatively influence the good name he has created for himself over the years, in the belief of the citizens of the Skywright municipality as well as the PDK branch, adding here to the fact that he was also a KLA general during the war.
Lushtaku in the indictment also points out that Durmish's statement has caused moral and dignity harm and that the same intended attempt to expose him to shame in his community.
In this indictment, Lushtaku refers to the Constitution of the Republic of Kosovo, to the civil law against slander, insult, then to the Law for Relations and Treatment of Slander and an insult by the European Court of Human Rights.
Lushtaku with the indictment also reserves the right to establish the value of application for compensation for nonmatial damage, which he will do in the judicial opening.
On top bases, Lushtaku is asking the court to approve his request, force the indictee to ask for public forgiveness for the slander made, so that the public can be informed of the debuking of Durmish's statements, according to him falsely, and be obliged to cover the costs of the procedure.
