The popular media warns the document: Association Under Franco-German Plan

Albanian Post, warns publication of the concept of the document for Association stemming from the Franco-German plan for tomorrow (November 15th).

Because one of the most problematic issues for Kosovo is the admission of point nine in the Franco-German proposal, which imposes implementation of all preliminary agreements, therefore forming the Serbian Major Commission Association, a team of international experts, has drafted a <x0-conceptor/advasory” how to form the Association without affecting Kosovo's constitutionality.

The nine-page document explains in detail what is the way to the establishment of association, until previously found that “The Association/Community of Serb Majorities is Kosovo's legal obligation by law ratified by the First Principe Agreement for Normalisation of Reports”.

However, the document refutes the idea of creating a non-government Association (as it refers to President Vjosa Osmani) or to the form of a non-government organisation.

“Kosovo's current association, founded through the Law on Freedom of Associations by the Nongovernmental Organisation, Article 16, explains at point 2 that the Association of This Kind (such as the current Association of Kosovo Communities) is made up of three or more people”, followed by “It's not an association from municipalities but from individuals”.

So, the Association of Serb-run municipalities can become part of an association founded by individuals rather than by municipalities themselves.

While the legal nosis is being spread even more, according to international experts, when it is said that association could be in the form of an NGO.

The municipality is a political sub-division of the state, a local government to offer government to a group of people within a certain territory, so “Since municipalities are part of the state, how can an organisation founded by the state be independent of the state?”.
