MPH Chief Inspector Bedri Halimi is again declared innocent in the case of “Prevalla”

The Special Department of the Foundation Court in Pristina has concluded yesterday the second retrial for corruption against the Ministry of Environment and Spatial Planning Chief Inspector (MMPH), Bedri Halimi, as well as three other inspectors of this municipality, Nexmetin Musliu, Union Krasniqi and Ruzhdzi Daka.
Yesterday at the beginning of the session, with the prosecution's proposal, it was recorded and read, as well as all accused claimed they did not feel guilty.
Afterwards, the chairman of the court, Judge Lutfi Shala, has concluded that the trial is declared complete, while declaring the court will take place on November 8th 2022.
All this speculation occurred after the prosecution's complaint, the Court of Appeals the first time on January 25th, 2022, had turned the case into retrial due to essential procedural violations.
With the reasoning that the court has completed the retrial review in a very short time, however, it has subsequently lost the sense of holding the session, Apel for the second time has turned the matter back into reevaluation.
In the Court of Appeals' ruling, it is said that the court review procedure in the review is short to that extent that it has violated the essence of the court review hearing, losing the sense of maintaining it.
The chairman of the court, Judge Lutfi Shala, in the trial has declared a free trial against Bedri Halim, declaring him innocent at all points of the indictment, reports “New age”
According to the Special Prosecutor's Act of the Republic of Kosovo (PSRK), set up on November 18, 2019, Bedri Halimi working as chief inspector of the Ministry of Environment and Space Planning (MMPH), competent for inspection of construction works at National Park “Sharri” in Prevalla has deliberately failed to perform the necessary tasks assigned to MMPH Minister No.34-13 of November 15, 2013, with which the destruction of non-licensive objects is ordered within the Urban Regulatory Plan in National Park, in a way that, even though it has drafted the plan for implementation of the ordinance in 4 phases, has not met it.
According to the indictment, 180 items had collapsed in the first phase, in the second phase of 28 decisions on collapse, only 20 were implemented, and eight decisions remained unmet.
According to the prosecution, in the third phase of 45 decisions on collapse, 16 were revoted, while 29 decisions have remained unmet, whereas the fourth phase was not implemented at all, so that 29 decisions were not implemented.
From December 14, 2013, and so far has not implemented one of the decisions, even though the same are still in force.
While the other four, Enver Bytyqi, Nedmetdin Musliu, Bashqi Krasniqi and Ruzhdzi Daka, according to the indictment as construction inspectors at the Prizren Community Inspectorate Directorate, have been responsible for inspecting construction work in National Park, in the period from June 22nd 2006, until May 3, 2013, when the MMPH with the M decision. No.1498-13, has ordered the suspension of all construction activities in the Prevala area.
According to PSRK, the same have deliberately failed to fulfill official reform duties on the No. 2004/15, have not made inspection oversight of construction, ordered no suspension of construction, and have not initiated the first procedures by law, so that over these seven years they have allowed construction of several hundred buildings without construction permits, reacting only on several occasions.
The prosecution claims Enver Bytyqi was involved in three cases of illegal construction of owners Sezo Beqiri, Fehmi Beqaj and Muharrem Brando, while Nexmetdin Musliu in two cases, of Irfan Beqiri and Blerim Bajraktari. On the other hand, the Union Krasniqi was reportedly involved in a case of owner Haziri Merlacu and Ruzhdzi Daka in a case of owner Kadri Bajrami.
With these actions, The PSRK says that this way they have caused the degradation of the environment in large measure, while each owner of the property built without permission has afforded the profit of wealth worth an average of 10,000 and 500 euros.
