The Ministry of Education cuts out SBASK's collective contract

In the August letter to the SBASK, provided by Reporter newspaper, the collective contract is said to have been cut off unilaterally from August, “based on the legal framework in power in the Republic of Kosovo, and due to lack of legal base, disparity with public order provisions and lack of legitimacy of the signatory”.
The collective contract in question was signed by the SBASK and the Kosovo government on January 21st, 2021, during the time the prime minister in office had been the Avdullah Hoti Government.
Consequently, according to Minister Arberie Nagavci's decision, the contract has no legitimacy since the signed period was signed by a minister of a government in office.
“The Kolektive Caltra of January 22, 2021, signed between the representatives of the SBASK and AugustI (from now referred to as: The Kolektive contract or contract, through this statement on the Disconnection of the Kolective Count (from here onward referred to as: The announcement) splits unilaterally from the MSTATI side, based on the legal framework in power in the Republic of Kosovo, and due to lack of legal base, disparagement with public order provisions and lack of legitimacy of signatory side”, says the letter of the Education Ministry to the SBASK.
Also, MANT in the decision says the incumbent government has also lacked <x0 constitutional authority to exercise respective competencies”, therefore the signing of this collective contract.
In fact, the contract was signed 30 days after the Constitutional decision, which sent the country to elections.
“However, the Kolektive contract is signed on January 21st, or 30 days after the Constitutional Court announced the case concerning Ko95/20 and 26 days before holding parliamentary elections in the Republic of Kosovo. The government Hoti, which, according to the Constitutional Court's interpretation in the case of Ko72/20, lacked constitutional authority to exercise respective competencies has not had the legitimacy to be party to procedure and therefore, nor to sign the Kolektive Treaty with the SBASK”, says the Education Ministry's decision.
The Kolektive contract provided education workers with coverage of travel spending for teaching, Jubilar rewards, satisfaction compensation and other benefits.
