Khashoggi, a prominent critic of the government in Riyadh, was killed at the Saudi consulate in Istanbul in October 2018.
American intelligence said earlier that he believes bin Salman ordered the murder.
But in court documents, the US State Department has said it has immunity because of its new role as prime minister of Saudi Arabia.
The immunity doctrine the heads of state have is recognised according to the international custom law”, American Department of Justice lawyers have said.
However, the administration of the American president, Joe Beiden, has said the decision does not mean how he is innocent.
Bin Salman has been appointed prime minister of Saudi Arabia in September of this year.
He repeatedly denies that he had a role in Khahogg's murder.
Khashogg's fiancée, Hatice Cengiz, said through a Twitter post that <x0mial has died today again”, while commenting on the verdict.
Saudi Arabia has said Khahoggi, former columnist of the American daily Washington Post, has been killed in a “operation” conducted by a team of agents who have been sent to Istanbul to convince him to return to the kingdom.
Khashogg's murder has been condemned worldwide and is believed to have damaged the image of the crown prince, the de facto leader of Saudi Arabia. / REL
