On the basis of the preliminary judge's decision on the appointment of this conference, it is said to be discussed in its case as to obtaining evidence, translations, defence investigations and further steps and other issues.
The decision says that in terms of extracting evidence, it will be required to know whether progress has been made in the intelligence process regarding the 107th Rule material, in particular, how much of this material remains to be cleaned up and whether any additional applications in accordance with this rule are inevitable.
Regarding translations, the preliminary judge has sought to be informed whether the administration can provide an update for unresolved translations, in particular the progress of the translation of the further amended indictment and the 109 (c) Rule chart and its completion.
As for defence investigations and further steps, it will be required to know whether defence can provide more information on the status of their investigations, especially what steps they have taken to advance their investigations.
On the other hand, it will be required to know whether the SPS foresees any difficulties in securing the list of the first 40 witnesses aimed at calling to trial by November 18th, 2022, the Vocit for Justice reports.
“b. Regarding rules of 153, 154 and 155 of the Order, it is noted that there are witnesses who have given several statements of witnesses; would the SPS be able to show (through the ERN of the document) which declaration (at) is intended to offer for admission under these rules; and c. If the parties anticipate any difficulties in transferring this case to a court around the end of the year, and if the parties predict any difficulty in presenting themselves to a court immediately after the surrender of the” case, it is determined further on that decision.
Finally, parties and participants are said to be invited to show whether they anticipate the need for a December conference before transferring the case to a court.
The Specialised Prosecutor's Office, on September 30th, has handed over the confirmed amended indictment against Hashim Thaci, Kadri Veselin, Jakup Krasniqi and Rexhep Selimi, which consists of ten points of charges, where they are charged with war crimes and crimes against humanity. That, after the judge had partially approved Hashim Thaci's defence motion, submitted to the amended indictment in the case where he and Kadri Veselin, Jakup Krasniqi and Rexhep Selimi are being charged with war crimes, and the SPS was ordered to make changes to the amended indictment.
In this indictment, it is said that through actions and inactions described above, Hashim Thaci, Kadri Veselini, Rexhep Selimi and Jakup Krasniqi, have conducted through their participation in a joint criminal enterprise and/or have assisted and promoted crimes charged in this indictment.
According to the prosecution, in addition to this or alternative, Hashim Thaci, Kadri Veselini, Rexhep Selimi and Jakup Krasniqi are responsible for crimes committed by their subordinates.
At that point, the indictment says Thaci, Veselin, Selimi and Krasniqi either knew or had reason to know that the crimes charged in this indictment were ready to be committed or committed by their subordinates and had not taken necessary and reasonable measures to prevent such crimes or punish its authors.
