Jashar adds that non-excusing salaries for strikers is contrary to the Law on the strike.
According to him, the government does not want to issue disciplinary measures against the strikers.
“According to definitions and obligations conveyed by the law on the strike, I think there is no right because in certain provisions the Law on Strikes regulates this issue and sets decidities for the Government that in such cases should not disseminate disciplinary measures, layoffs or material punishments, so it is a very classical provision in the sense of protection offered to strikes”, Jashar said.
Speaking on this issue, Jashari says the government has the right to send the subject to the Court, but it is sceptical that such a thing can be obtained against the strikers.
I believe that yes, but for not coming to such a situation, there is another provision of this same law that imposes Government to forward the case to the Court so that it can assess whether the strike was legal or illegal, and on the basis of that other payments that could flow”, Yasar says.
