This is a sentence that cannot be appealed and executed immediately, but it is not known how it will be condemned and whether it has been pending since 2013.
Why is this happening? The Italian Constitution prohibits the extradition of Brazilians and the Treaty for Judicial Co-operation on Criminal Affairs between Brazil and Italy, signed in 1989 and still in power, does not provide for the implementation of a conviction imposed by the Italian judicial system on Brazilian territory.
That means Robinho will not be taken to prison, but will be arrested if he leaves Brazil, as his country does not accept “ ” decisions made by the Italian court.
In any case, the Italian state will have to issue an international warrant that could be executed in other European Union countries.
At the same time, the victim's lawyer, Jakop Gnocchi, spoke after the ruling: “More than 15 judges reviewed the case in the first, second and third degree and confirmed my client's denouncing. Now we have to see how this sentence will be fulfilled, Brazil is a big country, and I hope it knows how to cope.
The sentence must be met for us. If he were in Italy, he would go to jail. “Now the ball is in Brazil's hands, which will have to act on its” constitution.
