The Witnesses were meant to be heard at Wednesday's session, but the chairman of the court, Judge Agim Kuci, had announced that their absences had reasoned through their representative, attorney Alban Makoli, with the argument that they are not found in Kosovo and that they are not known when they will return.
Regarding the hearing of these witnesses, special prosecutor Haki Gecaj said the same were deliberately avoiding witnessing in this case. Gecaj, not to procrastinate the procedure, has proposed that their statements be read in all phases of the procedure, reports the “Justice Trust”.
Kosovo lawyer Kelmendi, who defends accused Enver Sekiraqa, has partly agreed with prosecutor Gecaj's proposal, proposing that only the statements given in the trial be read, not those in earlier stages, as according to her, defence has not been given the opportunity to reject those statements.
But the court has rejected the prosecutor's proposal for reading statements, as according to Judge Red this trial is under way before another court.
He has said that for the security of the same courts, the court will issue a warrant for police conduct.
“For securing their presence at the next session, a warrant will be issued for their conduct by the police. In this case, we will also receive official confirmation if they are found outside the country”, the Red Judge said. The next session is expected to be held on January 25, 2022.
