These actions, the defendants had taken to challenge the agreement reached between Kosovo and Serbia for normalising relations.
In the indictment, provided by “Justice Vowtim”, established in March 2014, results in charges of this criminal act along with Minister Svecla are Dardan Molyqaj, Arsim Maqastena, Pacim Havoli, Agron Kabashi, Egzon Azazi, Pajtim Demaj, Frasher Krasniqi, Noushi, Bekim Shkodra, Andrim Hoxha, Sami Avdiu and Besniki.
They are charged that in the protest, organised on June 27, 2013, against ratification of the agreement on normalisation of relations between Kosovo and Serbia, they have thrown stones, color, glass spheres, bottles and pyrotechnics against some police officials, with four police officers being injured and four official vehicles damaged as a result.
Indictee Bekim Shkodra is also being charged with the criminal act of assaulting the official person during the official duty.
According to the indictment set up on March 14, 2014, by Pristina Constitutional Prosecutor Dardan Moliqaj, Arsim Maqasten, Arsim Havoli, Agron Kabashi, Egzon Azemi, Pajtim Demaj, Jelal Svecla, Frasher Krasniqi, Nol Nushi, Bekim Shkodra, Afrem Hoxha, Sami Avdiu and Besnik Celaj are charged that on June 27, 2013, on the “nerez 11x1> street in Pristina, during the protest with the intent of damaging Kosovo police officials having committed violent actions.
Always according to this indictment, Svecla and the other accused are charged that during this protest, stones, color, glass spheres, bottles, pyrotechnics in the direction of members of the Kosovo Police, where, as a result of these slight bodily injuries, police officers have suffered Rifat Geci, Halil Syla, Agim Xheli and Union Hyseni.
According to the prosecution, material damage has also been caused during the protest, where official uniforms and equipment of police officials were damaged during maintaining public order and safety, and have also damaged two cars, Kosovo Government property and two Kosovo Police owned cars, causing serious consequences.
With these actions, the prosecution charges the accused that each single person has committed the criminal act “participation in the crowd that committed criminal acts and hooliganism” by Article 412 paragraph 3 concerning paragraph 4 of the Republic of Kosovo's Criminal Code, which is the work for which penalty is provided with a fine fine of two hundred (,200) to ten thousand (1 000) Euro for hooliganism with minor consequences or imprisonment of up to five (5) years in prison for hooliganism with serious consequences.
While the second device of this indictment, Bekim Shkodra, is also tasked with the criminal offence of “the assault on the official person during the performance of the official task” by Article 410 paragraph 2 of the KPRK, the work for which the chief is sentenced to prison of six (6) to five years.
