In severe condition: Court to examine the health of Malisheva chairman

The decision was made following the defendant's defence proposal, lawyer Emrush Kastrati, reports the “Justice Trust”.

In the initial review, which was scheduled to take place today, lawyer Kastracti asked the court to provide his defense with a medical examination, since, according to him, the same is not in good health to submit the trial.

“We think and propose to the court to appoint relevant lab medical experts who would be declared on the circumstances of the possibility of whether the accused Begaj is able to submit the trial review”, lawyer Kastrati said, after which the statement was handed over to the court.

He asked the tribunal, which in accordance with Article 310 of the Criminal Procedure Code, to prove the status of the accused now and the fact that the circumstances claimed by the defence have been submitted since the conduct of the criminal act.

After that, Judge Naman has approved the defence proposal, arguing that it is based and finds support in the evidence delivered.

Judge Naman stated that the court would order medical examination for the accused Begaj to prove the same is capable of following the trial. In this case, the initial review session has been extended indefinitely.

Otherwise, this session was not allowed to be filmed by Judge Naman because of the accused's state of health.

According to the indictment filed on April 7th, 2021, Ragip Begaj is accused of being on July 6, 2018, in the quality of the official person, respectively, as the mayor of the Malisheva municipality, deliberately and using official authority has exceeded its competencies, causing damage to Rexhep Rudi and the Malisheva municipality budget.

The indictment said that accused Begaj, on November 7, 2018, has assigned the location for building the school in the village of Panorc, where he had promised the injured to enter into agreement on exchange of land for the purpose of building the school.
