Retrial of “People's Eye”: A lawyer crashs with a court member

After the Kosovo Court of Appeals turned the case to zero “The People's Office”, with the request that the Special Prosecutor arrange the accusation, it has come with an improved new indictment. According to the new indictment, there are only Sadri Ramabaja, Avni Llumnica and Bajrush Konjusha, where judgment has already ended for the latter.

Llumnica is accused of attempted killing Azem Vlads in co-ordination with the late Murat Jashari now. Ramabaja, however, is accused of helping the accused commit the criminal act of attempted murder.

Initially, witness Azem Vlasi said he stood in whole near his statement made in the preliminary trial, on July 16th 2018, as well as the statements issued in the investigator prior to the establishment of the indictment.

In the retrial of the case known as “The Eye of the People”, where Sadri Ramabaya and Avni Llumnica are being charged with helping try to kill Azem Vlasi, the latter has been heard in quality of witness at Monday's session.

After the Kosovo Court of Appeals turned the case to zero “The People's Office”, with the request that the Special Prosecutor arrange the accusation, it has come with an improved new indictment. According to the new indictment, there are only Sadri Ramabaja, Avni Llumnica and Bajrush Konjusha, where judgment has already ended for the latter.

Initially, witness Azem Vlasi said he stood in whole near his statement made in the preliminary trial, on July 16th 2018, as well as the statements issued in the investigator prior to the establishment of the indictment.

Witness Vlase said that based on the subject papers, he realized that the accused Llumnica had a role in the preparation and act of assault on him, the attack carried out by the late Murat Yashari.

“I know, based on the paperwork of this subject and on what the investigator found regarding the role of Avni Llumnica in preparation and in the act of assault on me on the part of his best friend, who, in turn, accompanied him from driving from Switzerland to trying to escape when he did the work, Murat Yashar has carried out the attack on me, and told him by phone and drinks coffee, but he's gone. I know these on the basis of subject papers”, said witness Azem Vlasi.

According to witness Vlasi, the crucial moment in this case has been the meeting at the motel “Fontana”, between Murat Jashar and the accused Llumnica and Ramabaja, two days before the attack on him.

Vlases has said that he takes into account the fact that the late Murat Yashar, according to expertise, was treated as a sick person, was clearly the conclusion that he had practical help and incentive to perform this act.

And since with expertise and indictment, Murat Jasarou was treated as a decent man, who has directly carried out the attack on me, the conclusion according to me is clear that this man, with no concrete incentive, without concrete help from right up to me, which is the moment and I beg you from the paperwork to take the testimony of the late Ramiz Mavriqi<1>, Vlasi added.

Afterwards, the defender of the defendant Llumnica, lawyer Naim Rudari, has asked the witness Vlasi where his claim was based, that Murat Jashari has been urged to take concrete action, which Vlads said was confirmed by documents that were part of the subject.

He has denied ever before knowing the accused Llumnica before the critical event.

Then, during the course of this session, there has been controversy between defenders of accused Sadri Ramabaja, lawyer Ramiz Krasniqi and juro members Judge Valon Kurtaj.

The reason for this has been asked by the lawyer Krasniqi at the address of witness Vlasi, with the content: “that we are dealing with a decision that dates back to 01.03.2017, which requires the development of investigations to Murat Jashar for two heavy works, and that Jashari according to the evidence in Kosovo entered 06.03.2017, with a regular passport, the question is this: what does such an act mean to you and why the suspect, Murat Yazuru, has not acted to arrest him?

Then, the court member, Judge Valon Kurtaj, has reacted, who has asked the witness Vlads not to answer that question.

After that, lawyer Ramiz Krasniqi addressed Judge Kurtaj with the words: “You have prepared the subject, because you have allowed him very well to respond. We're getting our first trial”.

In this regard, Judge Kurtay has answered that as a member of the court, he was equal to the chairman of this court and that this question had to be raised differently.

Following this statement by lawyer Krasniqi, Judge Kurtaj has demanded that he be marked with a remark in the chip.

To that move, lawyer Krasniqi has again reacted, responding to Judge Kurtaj that he had no right to note remarks and that he was unprepared for the subject.

You have no right to warn me, you have no right. You're unprepared for the subject and you're imposing. Too bad you didn't take the class, I had to be head of college”, said lawyer Krasniqi.

At the end of this situation, Judge Kurtaj has been addressed to the lawyer Krasniqi with the words: “you're still more offended or lawyer”, reports the “Justice Vow”.

Similarly, in this judicial investigation the parties have also given their opening address, with cases of prosecutor Burim Cherkini saying evidence will be presented during this trial, in which case the accused committed the criminal acts they were charged with.

According to prosecutor Cerkini, witnesses will be heard and material evidence administered that will contribute to the confirmation of the actual situation described as in the indictment.

Similarly, the representative of the injured Azem Vlasi, lawyer Nasuf Hasani, has declared that given the evidence to be administered, the prosecution's claim will be confirmed.

Opposing stance with the prosecution and the damaged party has submitted the two indictees' defence.

Initially, the defender of the accused Llumnica, lawyer Naim Rudari, said a poor practice had been created on the part of the prosecution, to present unfounded charges of evidence and concrete evidence, which, according to him, had taken place even in this case.

Afterwards, lawyer Rudari has expressed his conviction that the indictment will not prove any test of the indictment at all, for he said that such evidence had only been administered during the previous trial.

Like the defender of accused Ramabaja, lawyer Ramiz Krasniqi has named the P indictment The SRK as unprofessional, on the pretext that it has not respected the remarks given by the Court of Appeals at all.

According to lawyer Krasniqi, this indictment was built on four falsehoods, which will in no way prove true during the trial management.

The new indictment is built on four lies, which the dictionary of the Albanian language clearly defines what is untrue. I'm not saying this sentence for the sake of the court. What are these falsehoods which, during the trial management, will in no way prove, even the prosecution's proposal of evidence itself, say otherwise in the accusation act”, lawyer Krasniqi said.

At the end of his opening speech, lawyer Krasniqi has said that Azem Vlases well knows who had victimised him and that he must have made it clear that he was neither a victim of Sadri Ramabaya nor of the late Murat Jashar.

With the opening address given by lawyer Krasniqi as a whole, accused Ramabaja, who added that he felt victorious after saying the first charge of terrorism was dropped.

Later, accused Ramabaja said international justice would already be dealt with by those who, according to him, were authors of this indictment.

I feel victorious in the first battle of justice, I am pleased that the charge of terrorism has fallen, not only because of my person as a former political prisoner, and as university professor and author of books, but, above all, I am pleased with the Republic of Kosovo, that there will not remain in legal acts an attempt to impose a terrorist organisation. I am also pleased that international justice will now deal with those who were de facto authors of that act”, Ramabaja has said.

At the end of his statement, Ramabaja said that at the end of this trial, it would prove that the real victim was all those people who faced justice in this case.

The next session in this case is scheduled for April 19, at 09:30.

In this criminal case, Bajrush Konjusha has also been in the quality of the accused, but he has been sentenced to 300 euros in fines following the admission of illegal weapons.

Otherwise, this case is known as “The People's Office” had begun under the Special Prosecutor's Act of the Republic of Kosovo (PSRK), on February 27, 2018.

Avni Llumnica, Ragip Salova, Sadri Ramabaja, Sabit Berisha, Behxhet Luzha, Halim Halimi, Bajrush Konjusha, Lirije Luzha and Rexhep Toplana were accused of various criminal acts.

According to this indictment, defendant Avni Llumnica deliberately now the late M. J. To kill for revenge to harm Azem Vlads, he had helped J. to commit a crime.

Llumnica reportedly had brought the late M from Switzerland to Kosovo on March 6, 2017. J., had invited him to his house, and one day later he sent him to motel “Fontana” in Veternik, where he even paid for his sleep at this motel.

And, according to the prosecution's claims, when the defendant, now late M. J. Had committed a criminal offence against Azem Vlases, he and the accused Llumnica had met in the city, and after wanting to leave for Switzerland at 12 p.m. they were arrested by Kosovo Police.

With that, Llumnica was accused of committing criminal work “revenge in aid” by Article 396 KPRK's.

Llumnica according to this indictment as it was at the Lipjan detention centre on May 16, 2017, says that using the cano and force has violated the injured N.Z. by putting it in the detention room and forcing the same one to have oral sex. According to Llumnica, even before the case occurred several days earlier, he had sexually molested the man who was injured in speech.

Llumnica was charged with criminal work “violence” by Article 230 of KPRK's.

Defendants M. J., Avni Llumnica, Ragip Salova, Sadri Ramabaja, Rexhep Topalla, Bajrush Konjusha, Sabit Berisha, Haliim Halimi, Bexia Luzha and Lije Luzha, allegedly on May 15th 2017, were part of the people's “criminal organisation, with the so-called Rustema region somewhere in a European state, with the intention of destabilizing or destroying the fundamental political structures of the Kosovo Republic.

According to the indictment, the same reportedly had planned attacks and murders on top state personalities considered former officers of the 1980s-1991 as the country's traitors. These attacks, according to the indictment, were planned to carry out to Kosovo President Hashim Thaci, Parliament Speaker Kadri Veselin, former Prime Minister Isa Mustafa, former Prime Minister Hajredin Kuci, Xhavit Haliti, Fatmir Limaj, continuing with commanders of the KLA war, ATK director, religious clergy, etc.

According to the indictment, this group with the intention of killing those whom they considered to be traitors had founded the “Freedom of the Homeland” and as the organisation “The People's Office” had a structure divided under the hierarchy, had coded names and various tasks are said among the other in the indictment.

While, the defendant, now late, M. J. It is said that he had attempted to kill Azem Vlads as a former official who, according to them, was valued as the first on the country's traitor list.

In this, they were accused of committing criminal work “preparing terrorist or criminal acts against the constitutional order and security of the Republic of Kosovo” by Article 144 I KPRK's.

The defendant Bajrush Konjusha was also charged with criminal activity “ownership control, or unauthorized possession of weapons “since a gas pistol and a 250-sharp air rifle had been confiscated in his house.

And the late M. J. By the PSRK, it was tasked with criminal acts “capitalisation” and “storage in ownership, control or unauthorized possession of weapons”.

At the same time, the indictment says that J., was initially interested in Vlads engaging in civil affairs as a lawyer, while he told him that he did not deal with civil affairs, suggesting that he be directed to another lawyer and after second contact with him, the accused has pulled out the type “Crvena Zastava”, with a deafer pointing to the victims.

Furthermore, the prosecution claims that Vlase has captured the dead man J. And seated, which influenced the bullet to hit Vlad on the left side of his chest, causing serious bodily injury. They were trapped and then fired from the scene to meet with defendant Avni Llumnica, to be arrested by police at motel “Fontana”, Veternik.

According to the indictment, after police had made a search at motel “Fontana”, at the late J, had been found and confiscated a type “Crvena Zastava”, 70-65 mm calibration model, cremator and a 7-shooter, which he used without permission.

According to this indictment, the Constitutional Court in Pristina, led by the chairman of the panel, Naim Krasniqi é Jashanica and Judge Vesel Ismajli and Valbona Musliu Selimaj, had taken the conviction with which the accused had pleaded guilty.

Sadri Ramabaya, M. J., Ragip Salova, Avni Llumnica, Bexhet Luzha, Halim Halimi, Bajrush Konjusha and Rexhep Toplana, in January 2020, were convicted of criminal acts against constitutional order and other criminal acts.

Avni Llumnica for her revenge offense has been sentenced to three years in prison for one year's rape, and for terrorist acts, 10 years in prison, his sentence has been pronounced unique to 12 years in prison. For terrorist criminal acts, Sadri Ramaba was sentenced to 5 years in prison, while for the same criminal offence, accused Ragip Salova had been sentenced to 4 years in prison, while Rexhep Toplana had been sentenced to 2 years.

The late M. J. Because of his condition, the court had pronounced him compulsory psychiatric treatment for 10 years.

Behxhet Luzha for failing to announce the crime was sentenced to two years in prison.

Halim Halimi and Bajrush Konjusha had been sentenced to three years in prison. In addition to prison, Konjusha with 300 euros in fines for illegal possession.

To accused Sabit Berisha and Lirimje Luza had been rejected, since the prosecutor had renounced prosecution.

But with the findings of the Constitutional Court, the Court of Appeals, which had turned the case into retrial, had even demanded that the case return from the initial review due to inevitable violations.

Apel's decision states that “criminal case turns into restoration to be processed by initial consideration and following the regulation of the indictment act”.

This decision had led the Special Prosecutor to present a new indictment with many changes after several months.

According to the indictment of October 27, 2020, Sadri Ramabaja, Avni Llumnica and Bajrush Konjusha are the only ones charged in this case.

This is because the SPRK renounces criminal acts against constitutional order, respectively, of doubt of the existence of a criminal group “People's Eye”.

With the new indictment, Llumnica is accused of co-ordinating with the late M. J. They had tried to deprive themselves of life, Azem Vlads.

Ramaba is accused of helping Llumnica and M.J. carry out strikes against the injured Azem Vlasi, meanwhile Bajrush Konjusha is accused of the criminal act of armed maintenance.

Regarding the charge against the late M. J., according to Apel's decision, since the same was suffering from mental illness, his case had been delegated to the Founding Prosecutor in Pristina, which has been exercising proposals for the appointment of the extent of compulsory psychiatric treatment. /Betimi for Justice/
