In his letter, lawyer Keohe said that Marty's entire report was included without any basis in the court's Special Chamber documents.
He has said that after 10 years of investigation, the Special Prosecutor could confirm which part of these charges can't be verified, but that by quoting the statement of former Williamson's prosecutor, Keohe has said there is not enough evidence to prove the allegations of Marty's report.
Significantly, the prosecution does not address why Marty's entire report was raised to the status of “Bundar” on DSK's website; a legal classification that cannot be found in the Constitution, the DSK Law, or the Law of Procedure and Evidence. If the claims involved in Marty's report conducted the prosecution's initial investigation and determined its damaged jurisdiction as the prosecution now claims, it could thus far confirm, after ten years of intensive investigation, which parts of Marty's report were not true. Of particular importance is the statement by SITF Williams' chief prosecutor in 2014 that he failed to find sufficient evidence to support the charges regarding Marty's organ trafficking report claims. On the other hand, Keohe has said that as a result of this uncertainty, the Spoicial Prosecution is taking advantage of the public session that caused Marty's unbashed report.
According to Keohes, the prosecution had moved the court to the Netherlands, based on Kosovo portrayals and its political leadership as a mafia organisation.
The reason for this continued and deliberate lack of clarity is that the SPO continues to benefit from public sensationalization caused by Marty's report's groundless claims. These Keohes complaints come at a time when the lawyers of KLA leaders from day to day show that none of Marty's charges, whose report became a cause for the establishment of specials, are included in the indictment.
So far, the Special has repeatedly rejected the release of KLA leaders from custody.
