Procrastination of judicial procedures in Kosovo is a violation of the citizens' fundamental right to have judicial protection and judicial justice, Ombudsman Naim Celaj said in an interview for EO.
Furthermore, Celaj said the Judiciary Council, even the Prosecutorial Council, should take concrete steps to resolve the issue of procrastination of judicial subjects.
“Determination of judicial procedures is a concern, and the Judiciary Council and the Prosecutorial Council need to take very concrete steps to resolve this issue that procrastinations for years where citizens undoubtedly seek solutions to their problems is denied justice, and in this direction we violate a fundamental right to have judicial protection and judicial justice”.
“As far as measures should be taken by competent institutions despite the fact that we do not have direct intervention mandates because we preserve institutional independence, we will undoubtedly come up with a very concrete report on how to resolve this issue”, he said.
Also, Celaj also spoke of recent arrests by the Special Court, where he said he felt worried.
On the other hand, it shows that if this court commits violations, then the special ombudsman under the Specialised Court Chambers in The Hague will handle them.
“Undoubtedly as any citizen of the Republic of Kosovo I have felt with concern even the institution does not have an interest in how to solve the whole situation that has been created with the recent arrests of”.
The “however, in the context of the Court's Specialised Chambers in The Hague, there is also a special ombudsman dealing with rights violations that this court could make or prosecution”, Celaj said.
