All three fear that Jarra along with Diana Berisha could make any addition to the “Foundation property. The Civil Society House”, nine organizations that lead them, therefore have asked the Court to reject the decisions of August 5, 2019, and limit the activities of the Foundation members by not allowing any movement that could result in the removal of property or the dissolution of the Foundation.
Astrit Istrefi, Burim Ejupi and Wisar Azemi, have filed charges against life in Jarres, Diana Berisha and the Public Administration Ministry, respectively, for some problems they faced after they jointly agreed to establish “Civil Society House Foundations- SC”
As stated in the indictment of Istrefi, Ejupi and Azem, after the founding of the Organization on May 29, 2017, they had also written down the Founding Act, the founders of the foundation, the board of directors, and the authorized representative of the foundation.
The founders of this foundation in the indictment are said to be Astrit Istrefi, Burim Ejupi, Visar Azemi, Life Jarra and Diana Berisha (authorised Representative of the Foundation selected by the Board of Directors).
Istrefi, Ejupi and Azem, as shown in the case details in their indictment, between the 11th to August 20th of 2019, official paperwork had been sent to other members of the board to hold the regular meeting of the Foundation Board, however, say that by Life Xharra and Diana Berisha have received no answers.
They say Diana Berisha in the quality of the Foundation's Authorised Representative on August 5th 2019 had called to a regular meeting only Life Jarrea, who was headed by Hakki Abaz as the latter had helped purchase the 1m-euro facility that would serve the foundation's activities.
At the meeting of August 5th, reportedly in the indictment, Diana Berisha has appointed three new members of the Foundation, replacing Istrefi, Ejupi and Azem, with Faik Ispahiun, Fatos Lajci and Luan Dalipi.
According to plaintiffs, Diana Berisha has acted contrary to the Foundation's Status and has illegally chosen new members of the Foundation's board of directors.
Istrefi, Ejupi and Azemi in their indictment say the August 5th meeting is illegal since there has been no quorum to hold the meeting, since three board members have been missing, and only Jarra and Diana Berisha have attended.
The three have filed indictments against the Ministry of Public Administration for Nongovernmental Organisations respectively, saying they have legitimised the changes made to the Foundation's brochure by August 5th.
Seeing this, then on August 30th Istrefi, Ejupi and Azem have held a meeting of the Foundation Board, where they had decided to dismiss Diana Berisha from the Foundation's Authorised Representative position by replacing him with Learta Hollen.
These changes say all members of the Foundation Board have then officially announced, however, say they have received no answers from Jarra.
They later say they have turned to the Ministry of Public Administration-Department of Nongovernmental Organisations, where they have asked them to update the changes made by the August 30th meeting.
But they say that the Ministry of Public Administration-Department of NGOs had for the first time been officially notified of changes made on August 5th as a result of the meeting held only by Diana Berisha and Life Xharra, who was headed by Hakki Abazi, until they were denied their request to update NGO documentations, the dismissal of Diana Berisha and her replacement with Leart Holaj.
After all of this, as they say in their indictment, the Public Administration Ministry for NGOs has directed parties to address the judicial bodies for any disagreement respectively.
Istrefi, Ejupi and Azemi in their indictment seek by the Court to abolish the Public Administration Ministry-The NGO Department decision, as they say that such a decision by the three as members of the Foundation board is denied even the exploitation of the facility, which was bought in value of 1m euros.
The three plaintiffs in their indictment say there is also the real risk that life, Jarra and Diana Berisha, can make a decision to change ownership of the onem-euro facility. The plaintiffs say the life of Jarra and Dajana Berisha can carry ownership of the foundation object to their organisation leading (Balkan Investigative Journal Network B IRN-Life Jarra and Forum for Civic Initiative- Diana Berisha.
The plaintiffs in their indictment have sought to reject the decisions of the Jarres Life Summit, Diana Berisha and Haki Abbas. They have also requested that a temporary measure be set that limits the activity of Authorised Representative and Foundation Board of Directors.
It is required that no contract links be allowed on behalf of the Foundation for Exchange of Property, no appointment of board members, and no initiative be allowed to dismantle the Foundation.
