A million-dollar Civil Society house: Next week Court Sets Security Measure

“... The court has decided to force security proposses, on behalf of the security measure guarantee of depositing the amount of 3 thousand euros, totaling 9 thousand euros”, says the Foundation Act.
The plaintiffs' attorney (Astrit Istrefi, Burim Ejupi and Wisar Azemi), has said that during the next week the means will be deposited to open up the possibility of the Court deciding the security measure for the home of civil society.


“During the week, it is expected to be deployed”, Palushi told Express on Sunday.
However, the three plaintiffs, at the court hearing, had asked the Court to set up a temporary measure, as they said they feared that Dajana Berisha's life, along with the new board members, could alienate the property of 1m euros purchased with the help of Haki Abaz.
On July 3rd, the Pristina Foundation Court has held court hearings against Jairas and Diana Berisha following the indictment that was exercised against them by Astrit Istrefi, Burim Ejupi and Visar Azemi over a dispute linking with the “Foundation. The House of Civil Society SHC”, NGOs that had cofounded it.
Astrit Istrefi, Burim Ejupi, Visar Azma, Dajana Berisha's Life in 2017 were together to establish the <x0 Foundation The House of Civil Society SHC” The 5th were appointed board members until they were assisted by Hakki Abazi (high official in Vetevendosje and deputy prime minister in Kurti's government), who had managed to absorb a 1m-euro donation from Rockefeller Brothers Fund, headquartered in New York. For all that has happened next, the final verdict is expected to issue, as Istrefi, Ejupi and Azemi have filed charges against the life of Jarras and Diana Berisha, as they claim, Jarra and Berisha have held an illegal meeting where they fired them from the board and replaced them with Faik Ispahiun, Fatos Lajci and Luan Dalipin (the head of Kurt's staff as prime minister). The plaintiffs have also handed in indictments to the Ministry of Public Administration, since the Department for NGOs has updated the Foundation's data with changes made from the meeting between Jairas, Diana Berisha and Haki Abbas.
As stated in the indictment of Istrefi, Ejupi and Azem, after the founding of the Organization on May 29, 2017, they had written down the Founding Act, the founders of the foundation, board of directors, and the authorized representative of the foundation.
The founders of this foundation in the indictment are said to be: Astrit Istrefi, Burim Ejupi, Visar Azma, Life Jarra and Diana Berisha (Applied Representative of the Foundation selected by the Board of Directors).
Istrefi, Ejupi and Azem, as shown in the case details in their indictment, between the 11th to August 20th of 2019, official paperwork had been sent to other members of the board to hold the regular meeting of the Foundation Board, however, say that by Life Xharra and Diana Berisha have received no answers.
They say Diana Berisha in the quality of the Foundation's Authorised Representative, on August 5th of 2019, had called at a regular meeting only Life Jaryna, who was headed by Hakki Abazi, since he had helped purchase the 1m euro object that would serve the foundation's activities.
At the meeting of August 5th, reportedly in the indictment, Diana Berisha has appointed three new members of the Foundation, replacing Istrefi, Ejupi and Azem, with Faik Ispahiun, Fatos Lajci and Luan Dalipi.
According to the plaintiffs, Diana Berisha has acted contrary to the Foundation's Status and has illegally chosen new members of the Foundation's board of directors.
Istrefi, Ejupi and Azemi in their indictment say the August 5th meeting is illegal since there has been no quorum to hold the meeting, since three board members have been missing, and only Jarra and Diana Berisha have attended.
The three have filed indictments against the Ministry of Public Administration for Nongovernmental Organisations respectively, saying they have legitimised the changes made to the Foundation's brochure by August 5th.
Seeing this, then on August 30th Istrefi, Ejupi and Azem have held a meeting of the Foundation Board, where they had decided to dismiss Diana Berisha from the Foundation's Authorised Representative position by replacing him with Learta Hollen.
These changes say all members of the Foundation Board have then officially announced, however, say they have received no answers from Jarra.
They later say they have turned to the Ministry of Public Administration-Department of Nongovernmental Organisations, where they have asked them to update the changes made by the August 30th meeting.
But say that the NGO Public Administration-Department Ministry of NGOs had for the first time been officially notified of changes made on August 5th as a result of the meeting held only by Diana Berisha and Life Xharra, who was headed by Hakki Abazi, until they were denied their request to update NGO documents, the dismissal of Diana Berisha and her replacement with Leart Holaj.
After all of this, as they say in their indictment, the Public Administration Ministry for NGOs has directed parties to address the judicial bodies for any disagreement respectively.
Istrefi, Ejupi and Azemi in their indictment seek by the Court to abolish the Public Administration Ministry-The NGO Department decision, as they say that such a decision by the three as members of the Foundation board is denied even the exploitation of the facility, which was bought in value of 1m euros.
The three plaintiffs in their indictment say there is also the real risk that life, Jarra and Diana Berisha, can make a decision to change ownership of the onem-euro facility. The plaintiffs say the life of Jarra and Dajana Berisha can carry ownership of the foundation object to their organisation leading (Balkan Investigative Journal Network B IRN-Life Jarra and Forum for Civic Initiative- Diana Berisha.
The plaintiffs in their indictment have sought to reject the decisions of the Jarres Life Summit, Diana Berisha and Haki Abbas. They have also requested that a temporary measure be set that limits the activity of Authorised Representative and Foundation Board of Directors.
It is required that no contract links be allowed on behalf of the Foundation for Exchange of Property, no appointment of board members, and no initiative be allowed to dismantle the Foundation.
Hakki Abazi had provided a public explanation for the one million-strong civil society home and had attacked the media on how they reported on the case.
