The Albanian government has approved the normous act for provisional release from prison to prisoners, due to the Coronavirus, on the basis of certain criteria.
Under this decision, convicts who can obtain special permission to stay at home for a three-month period must meet certain criteria, such as: you have been left without being sentenced to up to three years in prison, there are no preventative criteria under Article 5 of this normative act, etc.
Criteria for the benefit of special permission:
The convict may obtain special permission to stay at home for a three-month period, in case on the date of the entry into force of this normative act:
- a) is condemned to a firm - form judicial decision and meets both conditions below: His sentence left him to serve up to three years in prison. It's not in the preventative criteria envisioned in Article 5, of this normative act.
- b) is sentenced to judicial decision of firm form and meets all the following conditions:
His sentence left him up to five years in prison.
- It is equal or over 60 years of age;
Hey. It has come from a chronic life - threatening disease, confirmed with relevant medical documents, according to the definitions of legislation in force;
- It's not in the preventative criteria envisioned in Article 5, of this normative act.
- The period of temporary stay at home, according to this article's definition, is included in the time of suffering punishment.
- If during the period of implementing the particular house temporary permit, the court decides to execute the sentence on an alternative sentence, according to Penal Code projections, particular permission, under this normative act, is abolished
They don't take special permission to stay at home, condemned persons for:
a crime against humanity,
b) life crimes committed deliberately
c) intentionally committed criminal acts against health
what sex crimes
d) Criminal acts against individual freedom
and) Criminal acts against children, marriage, and family
And a crime against wealth and the economic sphere.
A) crimes against independence and constitutional order,
f) terrorist purposes works
g) crimes against state authority,
against criminal acts committed by armed gangs and criminal organisations.
