Minister Mustafa suspends two main people in the Ministry of Agriculture suspected of abuses

Besian Mustafa, the new minister of agriculture, has suspended two of the leading men of the government dictatorship leading the country, who allegedly abused millions of euros of Kosovo's budget. After reviewing the documentation and thought it received from the Legal Office, the minister has decided to suspend”, a source in the Ministry of Agriculture has said.

Halimi, Gjokaj, former Prime Minister Nenad Rikalo, as well as five officials of this institution, have allegedly committed criminal work “The use of official position or authority”, punishable by prison of between 6 months and 5 years. The prosecution was put in motion after a review of the newspaper “Koha Ditore”, which had found illegal action to be taken in the ministry, through which at least three million euros of state were brought to some policy-related businesses.

To maintain function, they were using as protective weapons a law whose provisions are unappreciable.

The law for public officials, adopted last year, envisions in its 56th article, which the civil servant is suspended under the official duty of the current employers' body, “when the court decides on civil servants as a criminal measure preventing the suspension of duty or public service, under law in force”.

Article 85 of the same confirms that with its entry into force, the Civil Service Law -- which in Article 69 -- requires that the civil servant is immediately suspended from office when “against him/her has been initiated criminal procedure for carrying out criminal work during the exercise of his/her” functions.

This standard of Civil Service law is currently in effect, since the Constitutional Court has suspended the entire Law for public officials, including Article 85 referring to the abolition of the Law on Civil Servants. Consequently, to officials against whom the charges are filed are worth the old rules, which require suspension immediately after the indictment is filed against them.
