Hysni Gucati's defense lawyer: Waiting for a hearing.

Jonathan Elystan Rees, the defence attorney of Hysni Gucati, has provided no details about his health condition, nor about the possibility of his client's parole.

In a brief response to the Express, he has said they are awaiting the session to see the Special Prosecutor's decision.

We're awaiting the next hearing session. The prosecution determined its intentions regarding the preparation of each indictment during the last session”, Jonathan Elistan Rees has written.

The Prosecutor's Office in The Hague has said that within 30 days the indictment will be filed for the chairman of the Kosovo Liberation Army Veterans Organisation, Hysni Gushati, who allegedly obstructed justice, meanwhile, his defence called for parole.

At the Gucatit session, Jonathan Elystan Rees, defender of the OVL-KLA leader, has sought bail from his client. He said the veteran leader a day before the first hearing had a term for an operation dealing with his mobility, as he is disabled of war.

Besides, the former fighter of KLA, there are other health problems. He suffers from diabetes, high blood pressure, and asthma. All these health problems, his protector said they are enough to allow bail.

In addition, a guarantee of Hysni Gucatt's parole was offered. His defender provided 5 thousand euros guarantee that his client will not escape, that he will live at the address that is defined and will report to EULEX Police, but to the prosecutor of the case, Valeria Bolic was not enough.

“We can offer a 5 thousand-euro guarantee that he will live in the address he will determine, which will report to EULEX Police and all these conditions together, all of these respond to that risk of escape”, his protector said, adding that his client will stay away from the KLA War Veterans Organisation 100m.

For the special prosecutor, Valeria Bolic, the Gucati detention is necessary, as according to her, if released, he will continue to publish special documents.

Despite this, French Judge Nicolas Guillou has closed his first trial session by giving a “promise” to the chairman of the KLA War Veterans Organisation that he will consider the possibility of his release on bail from custody.

“Z. Gucati, let me say that under Article 51 and 57, I will review your ban, your detention, or at the request of your attorney, or at my initiative”, Guillo said.

Gucati has been arrested by EULEX on September 25th, at veterans' offices in Pristina, with another raid taking place that day. The same day, Gucati was transferred to the detention facility of Kosovo's Specialised Chambers in The Hague.

The same day, KLA OVL Secretary Nasim Haradinaj, who is also facing the Special Court in The Hague, has been arrested.

Against them has been issued for criminal acts against the administration of justice, respectively, for intimidation of witnesses, revenge and violation of the secret of the procedure, preceded in the Kosovo Criminal Code.
