In Vetevendosje they are continuing to blame President Thaci for failing to reach the coalition with the LDK.
She is the deputy head of the Parliament, Arberie Nagavci, who through a Facebook post said Thaci is partial and in this form is causing pressure and confusion on citizens.
According to Nagavci, legal matters are clear and in this form the president does not need to intervene.
However, Nagavci says either there should be governments mandated by Vetevendosje or new elections.
Her full post:
President Thaci, being partial and against LV! is trying to create confusion in citizens and pressure at LV! In institutional terms, according to the Kosovo Constitution, it does not have the importance and impact of the government's creation process.
Despite various statements and interpretations regarding forming the government, the Constitution stipulates that the right to proposal the mandate for forming the government is only LV!
The president appoints the mandate to form the government, following the political or coalition party proposal, which makes up the majority of the Assembly”. (R.K. Constitution. Article 84, parag.14).
The Constitutional Court of the Republic of Kosovo has solved and the issue of the majority of the Parliament, which according to the interpretation belongs to LV! which has the right to propose the candidate for mandate, president of the Republic. The president can decree the warrant only after this has happened.
Furthermore, the Constitution stipulates that, “if the proposed composition of the Government does not receive the most necessary votes, the president of the Republic of Kosovo, within ten (10) days, appoints the other candidate according to the same procedure. If not the second time the government is elected, then the president of Kosovo proclaims the elections, which should be held no later than 40 (40) days from the day of their proclamation.” (Nini 95 parag.4)
So the issue is clear and there is no need for the president of the country to pressure or create confusion in the sense of right to propose the mandate. Even in the first case, as in the second case, the right of the mandate proposal belongs only to Movement V. As far as LV is concerned, the deadline for proposing the name of the first mandate! The Constitution is silent.
This is the first and inexplicable argument, and in favor of this interpretation, there is the president's practical action when following Mr. Haradinaj, turned to Mr. Wessels as the PAN's first to propose the candidate for prime minister. The answer was negative and the country went to the polls.
So there's no way. Government mandated by LV! According to what was said or new choices. And in the country's interest is to establish institutions and start working for the state's effort to fight crime and corruption, for the country's development, so it's the Kurti Government.
